O presente trabalho monográfico tem por objetivo abordar o tema referente ao dano
existencial a partir de uma abordagem civil-constitucional, utilizando como suporte
conceitual, a construção do conceito de dignidade da pessoa humana e sua evolução históricofilosófico
que o elevou à categoria de princípio constitucional; a dignidade da pessoa humana
enquanto fundamento constitucional dos direitos fundamentais e direitos da personalidade; a
importância da tutela dos direitos da personalidade e sua influência na evolução da
responsabilidade civil para proteção dos interesses imateriais da pessoa humana. No tópico
seguinte, o estudo se voltará para os danos imateriais no ordenamento nacional; o dano
existencial, antecedentes, conceito e autonomia frente aos danos imateriais já prescritos pelo
ordenamento pátrio; o dano existencial no brasil. A presente pesquisa se valerá de revisão
bibliográfica incluindo artigos de autoridades no assunto, bem como, pesquisa jurisprudencial
para que seja possível constatar como os Tribunais estão recepcionando o conceito de dano
existencial. Buscará finalmente expor os melhores conceitos sobre dano existencial além de
elencar os elementos que configuram o dano existencial. Por fim, partirá para a análise da
fundamentação jurídica do dano existencial e sua compatibilidade com a Constituição Federal
de 1988, com o objetivo de averiguar se o dano existencial se assenta como autônomo no
ordenamento brasileiro.
The present monographic work aims to address the theme of existential damage from a civilconstitutional
approach, using as conceptual support, the construction of the concept of
human dignity and its historical-philosophical evolution that has elevated it to the category of
principle constitutional; The dignity of the human person as a constitutional basis of
fundamental rights and personality rights; The importance of protecting the rights of the
personality and its influence on the evolution of civil responsibility for the protection of the
immaterial interests of the human person. In the next topic, the study will focus on immaterial
damages in the national order; The existential damage, antecedents, concept and autonomy
against immaterial damages already prescribed by the patrimony order; The existential
damage in Brazil. The present research will rely on a bibliographic review including articles
of authorities in the subject, as well as, jurisprudential research so that it is possible to verify
how the Courts are receiving the concept of existential damage. It will finally seek to expose
the best concepts about existential damage besides listing the elements that configure the
existential damage. Finally, it will start with the analysis of the legal basis for existential
damage and its compatibility with Federal Constitution of 1988, with the objective of
investigating whether existential damage is based on autonomy in Brazilian law.
