O presente estudo investigará os efeitos que as legislações exercem no processo de Educação Ambiental no Brasil. O presente trabalho será metodologicamente operado por revisões bibliográficas e análises legislativas, recorrendo-se também ao estudo de caso, a partir de observações in loco no bairro da Ribeira, na cidade de Salvador-Ba. Será estabelecido uma dialética entre o Direito Ambiental e a Educação/Pedagogia, perpassando por questões sociológicas e antropológicas. A Política Nacional de Educação Ambiental, regulamenta o texto constitucional e prevê o ensino da temática com caráter transdisciplinar, sendo vedada uma autonomia disciplinar da matéria nos currículos dos cursos fundamentais, médios e superiores, exceção feita nesse último quanto a aspectos metodológicos. Contudo, ter a Educação Ambiental ramificada em todas as disciplinas da Educação Básica a tem limitado em meros projetos escolares e dissipado sua importância. Concluiu-se que vetar a disciplinarização da Educação Ambiental mitiga a operacionalidade da temática, sendo o veto integral um óbice a eficácia da norma Constitucional, que garante a Educação Ambiental.
present study will investigate the effects that the legislations exert in the process of Environmental Education in Brazil. The present study will be methodologically operated by bibliographical reviews and legislative analyzes, using also the case study, from in loco observations at the district of Ribeira, in the city of Salvador-Ba. A dialectic between Environmental Law and Education/Pedagogy will be established, going through sociological and anthropological questions. The National Environmental Education Policy regulates the constitutional text and predict the teaching of the theme with a transdisciplinary character, being forbidden a disciplinary autonomy of the theme in the curriculum of the fundamental, average and superior courses, excepting the last one as a methodological method. However, having environmental education branched out in all disciplines of Basic Education has limited it to mere school projects and dissipated its importance. It was concluded that vetoing the disciplinarization of Environmental Education mitigates the operationality of the issue, as well the integral veto is an obstacle to Constitutional effectiveness, which guarantees Environmental Education.
