Reparação civil ex delicto como fator restaurativo para a efetivação dos direitos fundamentais da vitima do delito rei

Abstract

O presente trabalho analisa a reparação civil ex delicto como fator restaurativo para a efetivação dos direitos fundamentais da vítima do Delito Rei. Parte-se do estudo do conteúdo concernente à vítima sujeito de direito e passivo do delito no Estado Democrático, à reparação civil ex delicto como fator restaurativo e como direito fundamental – uma vez que o contexto é, justamente, o da responsabilização e da efetivação dos direitos fundamentais da vítima. Após as análises, torna-se viável concluir que a vítima do Delito Rei é apenas o ser humano que suporta, de modo relevante, as consequências que emergem em decorrência do evento delituoso, que, além de nada contribuir para a sua materialidade, este lhe acarreta imensa diminuição em seu direito fundamental. O Delito Rei é conflito de interesses e vontades, assim sendo, somente quando curados os interesses e vontades de todos os envolvidos no conflito, é que a paz jurídica e social ficará restaurada, sendo essa restauração condição sine qua non para o retorno do autor do ilícito ao convívio social com maior segurança. A reparação civil ex delicto é o ressarcimento in pecunia feito por uma pessoa a outrem, para ressarci-la pelos prejuízos que haja suportado em decorrência do delito, como forma de restaurar, dentro do possível, a sua vida saudável e digna ante o evento delituoso. A reparação civil ex delicto é um direito fundamental que tem por escopo a garantia de condições materiais mínimas indispensáveis, para que o cidadão vitimado necessitado possa desfrutar de uma vida saudável e digna, de igual modo aos demais partícipes da vida em comunhão.

The present work analyzes the civil reparation ex delicto as a restorative factor for the realization of the fundamental rights of the victim of the King's Crime. It is based on the study of the content concerning the subject and lawful victim of the crime in the Democratic State, the civil reparation ex delicto as a restorative factor and as a fundamental right - since the context is precisely that of the accountability and the effective fundamental rights of the victim. After the analysis, it is possible to conclude that the victim of the King Delict is only the human being who sustains, in a relevant way, the consequences that emerge as a result of the criminal event, which, besides contributing nothing to its materiality, this one entails an immense diminution in its fundamental right. The King's Delict is a conflict of interests and wills, so that only when the interests and desires of all those involved in the conflict are healed will legal and social peace be restored, and this restoration is a sine qua non for the return of the author to social interaction with greater security. Civil reparation is the compensation in pecunia made by one person to another, to reimburse it for the damages they have incurred as a result of the crime, as a way to restore, as far as possible, their healthy and dignified life before the criminal event. Civil reparation is a fundamental right that has as its objective the guarantee of indispensable minimum material conditions, so that the victimized citizen in need can enjoy a healthy and dignified life, as well as the other participants in life in communion.
