Trabalho e adoecimento mental na categoria dos bancários: análise jurídica e da jurisprudência do TRT da 5ª Região

Abstract

This research focuses on the relationship between the work of bank employees and the development of mental health illnesses in this labor category, approaching the issue based on three main topics: the restructuring of production in banks, the judicial consequences of these illnesses as well as the application of jurisprudence on this topic. Upon analyzing the Brazilian Judicial system and how the International Labour Organization positions itself regarding this topic, it becomes evident that there is a protection network to ensure a balanced work environment and the health of workers, also including their mental health. With the objective of verifying the understanding of the phenomenon by the judicial branch of Bahia and the observance or lack thereof of the protection parameters on an international, constitutional and infra-constitutional level, a deeper look into the judicial decisions coming from the Regional Labour Court of the 5th Region was done, through this research it became evident that there is a mismatch, in this Court, between the advancement of the doctrine on this subject and the jurisprudence in recognizing the casual link between the psychological pathology and labour.
