Admirável trabalho novo: a uberização do trabalho e a precarização frente às novas tecnologias

Abstract

The Labor Law arose with the purpose of protecting the rights and interests of the sub-sufficient and sub-sufficient worker, that is, the subject who provides the service, the alien form, and the exchange of remuneration, subordination and the commands of a third party. In the context of the emergence of this legal branch, the whole project on subordinate work is built on the factory operator's operating sector, at the time when governed by the Fordism production system, exhibited by the intense manifestation of the employer's executive power over the employee. With neoliberalism and the industrial revolution 4.0, there was a change in the relationship with the regime of production. From this new perspective, with the insertion of new technologies, the Internet of things, the sharing economy, new forms of work have emerged with more flexibility and autonomy than the execution of work, thus distancing itself further from the classical form of subordinate work. To reflect on the new types of work, the role of the shared economy, investigate one of the most emblematic companies that use this process, an Uber company, a real possibility of precarious work. It turns out that classical subordination has become insufficient to protect new workers, who do not fit their narrow concept based on the completely different socioeconomic context of the current one. The new concepts selected different and more appropriate ways to verify the presence of legal subordination in the new labor relations. It does not refer to the dimensions of subordination and problem presented in this research, or more suitable model for working with the theme on screen or structural subordination. In conclusion, if this concept, allows bettering study the relationship between the driver and Uber, because the organization and requirements of Uber, to offer service delivery services and as indirect requests or requests to use the application. The methodology used seeks a qualitative approach, with the deepening of understanding of a social group and organization, as well as the use of bibliographic research, exploratory characters, consultations and clinical analysis of books, texts, articles, magazines, publications, virtual research and documentary research.
