O papel das madrastas nas relações familiares

Abstract

In this research work, we hope to demonstrate how profound social changes in recent decades have impacted families. In that respect, it is possible to realize an increasing number of couples who separate and form new families. However, with rare exceptions, Brazilian legislation seems to remain silent with respect to the regulation of new protagonists - i.e. stepmothers and stepfathers - who are increasingly becoming present in the very core of contemporary families. For that reason, this monograph, based on a gender perspective, seeks to investigate whether multiparenting is equally recognized in the female and male scope. For this purpose, we evaluate case law research from the website of the Court of Justice of Bahia, using specific search keywords (stepmother and affection; stepfather and affection; stepmother and affiliation; stepfather and affiliation; stepmother and socio-affectivity; stepfather and socio-affectivity and stepmother), in order to gauge at decisions about the recognition of socio-affectivity between stepfathers and stepchildren and between stepmothers and stepchildren from 2016 to 2020. Consequently, we hope to engage the world of "mosaic-families", demonstrating the importance of affective bonds in the full development of the children involved, aiming, for this purpose, to define the role of the stepmother within this context. *
