Abstract: | A presente monografia representa pesquisa sobre a aplicação do adágio in dubio pro societate, utilizando-se, para tanto, do recorte concernente a aplicação do princípio quando da pronuncia do acusado ao Júri Popular. Aplica-se o in dubio pro societate se verificada a existência de dúvida quanto à responsabilidade penal do acusado, invocando-se o dito princípio para que seja o réu pronunciado, ainda que haja divergência contundente quanto à materialidade delitiva ou aos indícios suficientes de autoria, indispensáveis à pronúncia, para que a dúvida seja posteriormente dirimida pelo Tribunal do Júri, em total arrepio à legislação vigente. O in dubio pro societate, em verdade, trata-se de violação expressa ao sistema acusatório adotado pelo Código de Processo Penal brasileiro, afastando princípios constitucionalmente protegidos como o estado de inocência e o in dubio pro reo, em total dissenso aos preceitos nos quais se fundam o Estado Democrático de Direito, acarretando em insanáveis prejuízos à defesa do acusado. A mais disso, a aplicação do apotegma viola a própria jurisdição, entendida como direito fundamental, pois permite a flexibilização de princípios indispensáveis como a indeclinabilidade da jurisdição e o devido processo legal. This monograph represents research on the application of the adage in dubio pro societate, using, therefore, the clipping concerning the application of the principle when pronounced by the accused to the Popular Jury. The in dubio pro societate is applied if there is doubt as to the criminal responsibility of the accused, invoking the said principle so that the defendant is pronounced, although there is a clear divergence as to the materiality of the offense or sufficient indications of authorship, indispensable for the pronunciation, so that the doubt is later settled by the Jury Court, in full shattering of the current legislation. The in dubio pro societate, in fact, is an express violation of the accusatory system adopted by the Brazilian Code of Criminal Procedure, removing constitutionally protected principles such as the state of innocence and in dubio pro reo, in total dissent to the precepts in which founded the Democratic State of Law, resulting in insurmountable damage to the defense of the accused. Moreover, the application of the apothegm violates the jurisdiction itself, understood as a fundamental right, since it allows the flexibilization of indispensable principles such as the indeclinability of the jurisdiction and due process of law. |
