A responsabilidade civil para falsa imputação de Paternidade com pagamento de Alimentos Gravídicos

Abstract

O presente trabalho tem como principal objetivo analisar a aplicação da Lei de Alimentos Gravídicos (11.804/2008) e a possibilidade da responsabilização civil da genitora em situações que haja a falsa imputação de paternidade. Para isso, no primeiro momento será feito um estudo da teoria da responsabilidade civil no ordenamento jurídico brasileiro, será abordada a sua evolução histórica, conceito, elementos e a sua importância para o direito. Além disso, será estudado o instituto dos alimentos, analisando a sua aplicação prática, os princípios que fundamentam a obrigação alimentar, os seus pressupostos de existência e principais características. Após, serão estudados os alimentos gravídicos e as suas peculiaridades, analisando o direito do nascituro, as teorias de início da personalidade jurídica, as limitações deste instituto e as controvérsias que giram em torno da Lei 11.804/2008. No momento posterior será analisada a possibilidade de responsabilização civil da gestante quando houver a falsa imputação da paternidade, levando em consideração a irrepetibilidade da obrigação alimentar.

The main objective of this study is to analyze the application of the Law of Gravitational Food (11,804 / 2008) and the possibility of civil responsibility of the mother in situations where there is false imputation of paternity. For this, in the first moment will be made a study of the theory of civil responsibility in the Brazilian legal system, will approach its historical evolution, concept, elements and their importance to the law. In addition, the institute of food will be studied, analyzing its practical application, the principles that underlie the obligation of food, its assumptions of existence and main characteristics. After that, gravid foods and their peculiarities will be studied, analyzing the right of the unborn child, theories about the beginning of legal personality, the limitations of this institute and the controversies that revolve around Law 11804/2008. Later, the possibility of civil liability of the pregnant woman will be analyzed when there is a false imputation of paternity, taking into account the unrepeatability of the food obligation.
