Reforma Trabalhista e Hermenêutica: Uma análise da atividade interpretativa da Justiça do Trabalho Pós-Reforma

Abstract

O presente trabalho tem por finalidade analisar as mudanças hermenêuticas trazidas pela Reforma Trabalhista de 2017 e como elas influenciam na atividade interpretativa da Justiça do Trabalho. Para tanto, é feita uma breve análise da Lei n. 13.467/2017, trazendo uma visão crítica acerca das alterações legislativas, das suas justificativas e tramitação e, também, do contexto político e econômico em que se inserem. Posteriormente, parte-se para um estudo sobre a Hermenêutica Clássica, suas Escolas e métodos e sobre a Hermenêutica do Trabalho pré-reforma, com foco na hierarquia das fontes normativas e princípios trabalhistas, objetivando subsidiar os capítulos seguintes. Por conseguinte, adentra-se, especificamente, nas viradas hermenêuticas trazidas pela reforma no âmbito do Direito do Trabalho, demonstrando quais são os artigos que mais influenciarão no processo interpretativo e integrativo do aplicador do direito e suas consequências para a principiologia e para a pirâmide normativa do Direito do Trabalho. Objetiva-se provar que existiram alterações hermenêuticas e defender a aplicação do estudo dessas mudanças à atividade interpretativa da Justiça do Trabalho, com o intuito de estabelecer como será parte do desafio de aplicar a nova legislação, respeitando todo o arcabouço normativo e axiológico de um ordenamento sistêmico e harmônico.

The present work aims to analyze the hermeneutic changes brought by the Labor Reform of 2017 and how they influence the interpretive activity of Labor Justice. To do so, a brief analysis of Law no. 13.467 / 2017, bringing a critical view on the legislative changes, their justifications and procedure, and also the political and economic context in which they are inserted. Subsequently, a study on Classical Hermeneutics, its Schools and methods, and on the Hermeneutics of Pre-Reform Work, focusing on the hierarchy of normative sources and labor principles, is proposed, aiming to subsidize the following chapters. Consequently, it focuses specifically on the hermeneutic changes brought about by the reform in the scope of labor law, demonstrating which are the articles that will most influence in the interpretative and integrative process of the applicator of the law and its consequences for the principles and normative pyramid of Labor Law. Proving that there were hermeneutic changes and defending the application of the study of these changes to the interpretive activity of the Labor Justice, aiming to establish how it will be part of the challenge to apply the new legislation, respecting the whole normative and axiological framework of a systemic and harmonic ordering
