Justiça restaurativa: a ressignificação da vítima a partir da resolução pacífica do conflito

Abstract

The monographic work entitled RESTAURATIVE JUSTICE: The resignification of the victim from the peaceful resolution of the conflict is presented here in the light of the understanding of Restorative Justice as a unique differential instrument for conflict resolution, by rescuing the participation of the victim in the reconstruction of his identity and the promotion of social pacification. In this sense, it proposes to answer a common question to those who do not understand the possibilities evidenced from restorative justice and its relationship with the victim: What is the effectiveness of restorative justice in the process of resignification of the victim from the peaceful resolution of the conflict? ? In order to seek answers to the problem presented, it aims to investigate the importance of Restorative Justice to resignify the victim from the pacification of the conflict. For this, it is necessary to critically analyze the current place of the victim in the criminal justice; understand the importance of the victim in the context of conflict solvers and critically evaluate pacification in the victim's reframing process in light of Restorative Justice. Regarding the research methodology adopted, an exploratory bibliographic research was carried out, based on the thinking of doctrineers who deal with Victimology and Restorative Justice.
