Caça ao folião pipoca: seletividade penal do delito de posse de drogas para uso pessoal no carnaval de Salvador em 2018.

Abstract

The study aimed to answer the following question: is there selectivity in the pursuit of the possession of drugs for personal use during the carnival of Salvador? To address this problem, the research used the hypothetical-deductive methodology, formulating the following hypothesis: In the carnival of Salvador, the selectivity of criminal control operates both in relation to the pursuit of the conduct of art. 28 of the drug law, as compared to other offenses, such as among the subjects conducted. In this sense, an empirical analysis of the detailed terms referring to the crime of art.28 occurred during the 2018 Salvador Carnival was performed. Following the methodology, the falsification process was performed through quantitative comparisons, based on data from the Criminal Coordination of the Public Defender's Office, referring to arrests in the act of committing other crimes of the same period and place, as well as quantitative of other drug possession procedures, in addition to deepening the analysis of each qualitative characteristic withdrawn through the processes. The theoretical framework that guided the research was the critical criminology, analyzing the reality from the economical macrosociological perspective, also using categories of the criminology of the labelling approach, especially the notions of moral entrepreneurs and labelling. In this sense, it was possible to realize that the dynamics of criminal prosecution against the crime of possession of drugs for personal use, during the carnival of Salvador, acquires its own rhythm, tending to have a racial and economicallyfactor of criminal selectivity.
