Acesso à justiça e cárcere: um estudo sobre a (des)assistência jurídica gratuita prestada pela Defensoria Pública do Estado da Bahia no Conjunto Penal Feminino de Salvador

Abstract

Esse trabalho visa analisar a questão do direito ao acesso à justiça no ambiente carcerário, especificamente a assistência jurídica gratuita prestada pela Defensoria Pública do Estado da Bahia às internas do Conjunto Penal Feminino de Salvador. Parte da hipótese de que existe uma linha de teorias sobre a Defensoria Pública, que oculta a influência e a presença do projeto colonialista e aristocrático, que estrutura o Brasil e seu sistema de justiça, excluindo a instituição da agenda de discussões críticas e políticas acerca do quadro histórico de violações a direitos e garantias fundamentais imposto às mulheres encarceradas. O universo da pesquisa é composto pelos processos judiciais das internas do Conjunto Penal Feminino de Salvador. Foi utilizada a metodologia documental, com perspectiva analítica, em uma abordagem que combinou a forma qualitativa e quantitativa. O estudo, a partir da análise crítica dos processos, percorre o seguinte caminho: (a) analisa, considerando aspectos raciais, de gênero e classe, o exercício do direito ao acesso à justiça e a cidadania; (b) discute a formação e estruturação da Defensoria Pública do Estado da Bahia, relacionando com o conceito de vulnerabilidade e com o perfil das assistidas; (c) descreve as consequências advindas pela ausência da prestação da assistência jurídica gratuita prevista na Lei de Execução Penal; (d) categoriza os dados sobre o perfil das internas e seus processos judiciais, considerando as questões de raça, gênero e sexualidade que os atravessam; (e) analisa a participação das defesas, dando ênfase ao papel da Defensoria Pública do Estado da Bahia no superencarceramento feminino no Estado. Após essas leituras, conclui-se pela necessidade de trazer a Defensoria Pública ao centro das discussões sobre encarceramento feminino, a partir da prestação de uma assistência jurídica gratuita que se afaste do caráter assistencialista e se aproxime efetivamente do seu caráter público, bem como pela utilização da categoria raça e suas imbricações de gênero, classe e sexualidade na atuação institucional da Defensoria Pública do Estado da Bahia.

This work aims to analyze the issues concerning access to justice in the prison environment, specifically covering the free legal assistance provided by the Public Defender of the State of Bahia to the inmates of Conjunto Penal Feminino do Salvador (Female Prison of Salvador). It departs from the hypothesis that there is a series of theories concerning the Public Defender’s office that hide the influence and presence of the colonialist and aristocratic projects which structures Brazil and its justice system, thus keeping the institution away of public and political discussions about the historical framework of violations of fundamental rights and guarantees that are imposed on incarcerated women. The universe of the research is composed of legal lawsuits of Salvador Female Prison’s inmates. The documentary method was used in this research with an analytical perspective, in an approach that combined both the qualitative and quantitative analysis. The study, based on the critical analysis of the lawsuits, has the following procedures: (a) analysis of the exercise of the right to access to justice and citizenship considering the aspects of race, gender and class; (b) discussion regarding the creation and structuring of the Public Defender of the State of Bahia making a relation with the concept of vulnerability as well as with the profile of the assisted women; (c) description of the consequences due to the lack of free legal assistance prescribed by the Criminal Execution Law; (d) categorization of the data on the inmate’s profiles and their lawsuits, considering the issues of race, gender and sexuality that intersects them; (e) analysis of the participation of the defenses emphasizing the role of the Public Defender of the State of Bahia in women’s over incarceration. After these examinations, it can be concluded that it is necessary to bring the Public Defender’s office to the center of the discussion on women’s incarceration, based on the provision of free legal assistance that distances from its welfare characteristic and effectively approaches its public characteristic, as well as its imbrications on the categories of gender, class and sexuality in the institutional performance of the Public Defender of the State of Bahia.
