Educar pela Pesquisa em Direito: a situação da Faculdade de Direito da UFBA

Abstract

A presente investigação parte dos questionamentos iniciais, quais sejam: Considerando a existência de uma na crise da educação jurídica a luz da pesquisa científica, quais as condições sociais, históricas e teóricas indicam rupturas ou continuidades (Malaguti, 2009), ao caracterizar o atual do Ensino Jurídico? Como se situaria a Faculdade de direito da UFBA nesse cenário? Partindo dessa premissa, temos como objetivo principal analisar em um primeiro momento, as bases de formação do ensino jurídico no país a partir da criação dos dois primeiros cursos de direito, realizando uma comparação com as regulamentações atuais, na busca de rupturas e permanências (Malaguti, 2009) de práticas educacionais implantadas pelas diretrizes educacionais ao decorrer do tempo. Pretende-se mais especificamente analisar como esse cenário viria a afetar a construção de uma ambiente de pesquisa nas Faculdades de direito. Neste item, busca-se analisar o pilar da pesquisa científica no Direito à luz da uma conceituação sobre educar pela pesquisa, e do enfrentamento ao paradigma da dogmática jurídica. Em um terceiro momento opta-se por situar a Faculdade de Direito da UFBA nesse panorama com suas atuais atividades de pesquisa cadastradas no Núcleo de Pesquisa e Extensão (NPE). Optou-se assim, neste último momento pela utilização da metodologia de análise de dados secundários, promovendo uma análise quantitativa-descritiva das amostragens de projetos e relatórios cadastradas na UFBA e na Faculdade, sugerindo por fim, novas políticas públicas de fomento à pesquisa na neste âmbito.

The present investigation starts from the initial questions, namely: Considering the existence of one in the crisis of legal education in the light of scientific research, what social, historical and theoretical conditions indicate ruptures or continuities (Malaguti, 2009), when characterizing the current Legal Education? How would the Faculty of Law of UFBA stand in this scenario? Starting from this premise, we have as main objective to analyze in a first moment the bases of formation of the legal education in the country from the creation of the first two courses of law comparing with the current regulations, in search of ruptures and permanences (Malaguti, 2009 ) of educational practices implemented by educational guidelines over time. It is intended to more specifically analyze how this scenario would affect the construction of a research environment in the Faculties of law. This article seeks to analyze the pillar of scientific research in the Law in the light of a conceptualization about educating by research, and the confrontation with the paradigm of legal dogmatics. In a third phase, the Faculty of Law of UFBA is selected in this panorama with its current research activities registered in the Nucleus of Research and Extension (NPE). In this last moment, we opted for the use of the methodology of secondary data analysis, promoting a quantitative-descriptive analysis of samples of projects and reports registered in UFBA and in the Faculty, suggesting, finally, new public policies to foment research in this scope
