Direitos Humanos Também para os Loucos: Uma análise crítica sobre o caso dos “desinternados” do Hospital de Custódia e Tratamento da Bahia

Abstract

O presente estudo tem por objetivo promover uma análise crítica acerca da manutenção, no Hospital de Custódia e Tratamento da Bahia, dos portadores de transtorno mental em conflito com a lei que já foram desinternados judicialmente, mas, por diversos fatores – que incluem a falta de políticas públicas de inclusão social e o abandono sociofamiliar –, permanecem internados. Assim, o que se pretende é discutir se o Estado, ao manter em estabelecimento prisional essas pessoas, em condições idênticas às do internamento, viola ou não a Constituição Federal de 1988 e as principais convenções internacionais sobre Direitos Humanos ratificadas pelo Brasil. Após breves digressões sobre o tratamento conferido pelo Direito brasileiro ao portador de transtorno mental ao longo da História – do Código Criminal do Império do Brazil à Lei Antimanicomial, serão discutidos aspectos relevantes a respeito do Hospital de Custódia e Tratamento da Bahia. Através de pesquisa documental, se pretende traçar um panorama do HCT/BA, bem como o perfil social dos “desinternados”. Como debate principal, será verificada, à luz da Teoria Crítica dos Direitos Humanos, eventual violação a essas garantias e a quais espécies, culminando numa breve discussão sobre formas alternativas ao internamento para enfrentamento da questão. Ao final, a ambição deste projeto é identificar se o tratamento conferido aos desinternados atualmente é o mais adequado e mais próximo do ideal de Direitos Humanos consagrado universalmente.

The present study aims to promote a critical assessment on the maintenance, in the Hospital of Custody and Treatment of Bahia, of patients with mental disorders in conflict with the law who have already been judicially discharged, but due to several factors - including the lack of public policies of social inclusion and social and family abandonment - remain hospitalized. Therefore, what is intended is to discuss whether the State, by keeping these people in prison, under the same conditions as if they were hospitalized, violates the 1988 Federal Constitution and the main international human rights conventions ratified by Brazil. After a brief discussion about the treatment historically offered by Brazilian law to the person with mental disorder - from the Criminal Code of the Empire of Brazil to the Antimanicomial Law, relevant aspects will be discussed regarding the Hospital of Custody and Treatment of Bahia. Through documentary research, we intend to draw a panorama of the HCT / BA, as well as the social profile of the "dismissed" interns. As a main debate, in the light of the Critical Human Rights Theory, a possible violation of these guarantees will be verified and to which species, culminating in a brief discussion about alternative forms of internment to face the issue.
