Um shopping no meio da feira: A descaracterização do Centro de Abastecimento de Feira de Santana e suas implicações jurídicas no campo da cultura

Abstract

Este trabalho monográfico abordará o processo de Registro Especial provisório do Centro de Abastecimento de Feira de Santana (CAF) instaurado no âmbito do IPAC. As práticas culturais desenvolvidas nesse espaço, diante da importância histórica e cultural que demonstraram para o território baiano, foram registradas provisoriamente pela autarquia estadual responsável pelo reconhecimento e proteção dos bens cultural materiais e imateriais da Bahia. O objeto de análise desse trabalho é o CAF, especificamente no que diz respeito à sua preservação enquanto sede da manifestação cultural reconhecida pelo Estado. Analisa-se a atuação dos envolvidos no processo de reconhecimento do CAF como bem cultural imaterial. Discutiu-se a possibilidade dos efeitos protetivos do instituto jurídico do Registro Especial incidirem também sobre o suporte físico (espaço/lugar) que abriga as práticas culturais imateriais registradas. Como metodologia de pesquisa foi escolhida a indução analítica para nortear a elaboração da presente monografia, sendo utilizadas as técnicas da observação e da análise documental. A conclusão do trabalho confirmou a capacidade protetiva do Registro Especial em relação ao espaço que sedia as manifestações culturais registradas, resultando, à semelhança do que ocorre com o Tombamento, na imposição de limitações ao direito de propriedade desse imóvel.

This monographic work will approach the provisional special registration process of the Feira de Santana Supply Center (CAF) established within the scope of IPAC. The cultural practices developed in this space, in view of historical and cultural importance demonstrated for the Bahian territory, were provisionally registered by the state autarchy responsible for the recognition and protection of material and immaterial cultural goods of Bahia. The object of analysis of this work is the CAF, specifically with regard to its preservation as focus of the cultural manifestation recognized by the State. Its analysed the acting of involveds on the recognition process of the CAF as cultural immaterial good. Wit was discussed the possibility of the protective effects of legal institute Special Registry also reflect on the physical support (space/place) that shelters the registered intangible cultural practices. As research methodology, the analytical induction was chosen to guide the preparation of this monograph, using the techniques of observation and documentary analysis.The conclusion of the work confirmed the protective capacity of the Special Registry regarding to the space that keeps the registered cultural manifestations, resulting, as in the case of Tombamento, in imposition of limitations on the property right of this propriety.
