A desapropriação judicial do art.1.228, §§ 4º e 5º do Código Civil de 2002 à luz da Função Social da Posse

Abstract

Essa pesquisa tem como pressuposto analisar o novo instituto previsto no art. 1.228 §§ 4 e 5 do código civil de 2002, com base na função social da posse, tendo como premissa a teoria da apropriação econômica da coisa desenvolvida pelo francês Raymond Saleilles. Quando há conflito entre a propriedade que não está cumprindo a função social e a posse que vêm sendo exercida há anos e dotada de função social, prevalece a função social da posse em detrimento do título de propriedade, cujo titular não estava promovendo a função social do imóvel.

The research analyzes the new institute foreseen in art. 1,228 §4 and §5 of the Civil Code of 2002, based on the social function of possession and on the theory of economic appropriation of the thing developed by the Frenchman Raymond Saleilles. When there is any conflict among a property that does not fulfill the social function and the possession exercised for years, endowed with a social function, this last one prevails to the detriment of title deed, whose owner was not promoting the social function of immobile.
