A Responsabilidade Civil do Estado brasileiro pelo uso de balas de borracha nas manifestações do movimento passe livre em 2013 no Brasil: sob a ótica do Estado de Exceção

Abstract

Nas manifestações protagonizadas pelo Movimento Passe Livre em 2013 observou-se forte repressão estatal, tendo como um de seus mecanismos de repressão o uso indiscriminado de balas de borracha, que, por sua vez, foi responsável por lesionar diversos manifestantes, transeuntes e jornalistas, esta é a história de Giuliana Vallone, Tatiana Farah, Sérgio Andrade da Silva, entre muitos outros que, ao cobrirem ou Cruzarem ou participarem dos protestos tiveram suas vidas marcadas pelo terrorismo de Estado. Este trabalho visa refletir, sob a ótica de Agamben, a ideia do estado de exceção sobre a responsabilidade civil do Estado, como a interseção do jurídico e do político torna a responsabilidade civil uma zona de indeterminação que permite e legitima a ação truculenta da polícia através da idéia de banalidade do mal, por sua vez, conceituado por Hannah Arendt e, por fim, como a indeterminação cruza com a não assunção dos risco em uma sociedade pós-industrial.

In the demonstrations carried out by the Free Pass Movement in 2013, a strong state repression was observed, with one of its repression mechanisms the indiscriminate use of rubber bullets, which in turn was responsible for injuring several demonstrators, passersby and journalists. Is the story of Giuliana Vallone, Tatiana Farah, Sérgio Andrade da Silva, among many others who, when covering or crossing or participating in the protests, had their lives marked by state terrorism. This paper aims to reflect, from Agamben's point of view, the idea of the emergency powers on the civil responsibility of the state, as the intersection of the legal and the political makes civil liability a zone of indetermination that allows and legitimizes the truculent action of the police through the idea of banality of evil, in turn, conceptualized by Hannah Arendt and, finally, how indeterminacy intersects with the non-assumption of risk in a post-industrial society.
