Limites à privacidade e à intimidade dos Agentes Políticos eleitos em prol do interesse público

Abstract

A presente monografia busca atribuir quais limites podem sofrer a intimidade e a privacidade quando em colisão com a liberdade de expressão e imprensa e direito à informação. Foi feita uma conceituação dos princípios em estudo, atribuindo diferenças e aproximações entre eles. Após, foi delimitado o objeto de investigação apenas aos agentes políticos, por se tratarem de sujeitos que sofrem constantes ofensas à privacidade pela imprensa. O conflito em questão, exigiu um estudo minucioso da teoria dos princípios e a colisão existente entre eles. Para tanto, foi feita uma diferenciação entre princípios e regras. Posteriormente foi atribuído os critérios determinantes na solução do conflito em estudo. A ponderação foi o método determinante para solucionar o problema. Seu uso decorre da verificação de casos concretos e atribui valores diferentes aos princípios a depender dos fatos analisados. Assim, para um melhor entendimento dos limites existentes nos princípios analisados, foi investigado dois casos concretos relacionados a atuação de agentes públicos.

The present undergraduate thesis intents to assign the limitations that intimacy and privacy can tolerate when in comparison with the freedom of the press and the right of information. Was made a explanation of the principles in analysis, establishing the differences and similarities between them. Then, was restricted the object of investigation only to the political agents, once they are persons that used to suffer frequent privacy offenses by the media. The conflict in question demanded a meticulous study about the theory of principles and their conflicts. Thus, was made the distinction between principles and rules. Subsequently, the procedure to establish the solution of the conflict under discussion. The ponderation is the method used to solve the issue. Your employment comes from the verification of hard cases and the values given to the principles will depend on the facts scrutinized. Therefore, to have a best understanding about the boundaries of the principles in question, two legal cases envolving political agents were examinated.
