Das possíveis contribuições da teoria simétrica para os estudos jurídicos: uma leitura simétrica da lei 13.467/2017

Abstract

A presente monografia propõe a construção de um ensaio jurídico à luz dos balizadores teóricos da simetria e da Teoria Ator-Rede, como pensadas pelo filósofo das Ciências Bruno Latour. Utiliza como lastro a pesquisa bibliográfica, visando os conceitos teóricos desenvolvidos por Bruno Latour e a pesquisa empírica com o intento de verificar de quais formas os conceitos da Simetria e da Teoria Ator-Rede podem ser utilizados nas ciências jurídicas, identificando as articulações possíveis e os impactos causados entre o discurso latouriano e o discurso das Ciências Jurídicas. Buscou-se retraçar os caminhos percorridos desde a apresentação do Projeto de Lei à Câmara dos Deputados pelo Poder Executivo até a sanção presidencial da Lei 13.467/2017 numa tentativa de reconstruir a participação dos principais atores-rede no procedimento ~para alterar o diploma legal que regula uma das principais relações sociais. Um olhar simétrico de como se deu a participação de cada ator-rede no procedimento da Reforma Trabalhista pode nos fornecer subsídios que nos permitam compreender como os mecanismos institucionais transitam entre Ciência, Política e Estado alterando as relações sociais. Pode também, provocar a campo jurídico a traçar outras reflexões sobre as formas são construídas as relações entre os diversos atores envolvidos no ritual jurídico compreendido desde o processo legislativo

This monograph proposes the construction of a legal essay in the light of the theoretical balizers of symmetry and the actor-network theory, as thought by the philosopher of the sciences Bruno Latour. It uses as ballast the bibliographic research, aiming the theoretical concepts developed by Bruno Latour and the empirical research with the intent to verify in which ways the concepts of symmetry and the actor-network theory can be used in the legal sciences, Identifying the possible joints and the impacts caused between the Latourian discourse and the Discourse of the juridical sciences.
