Entre a Cruz e a Espada a prática das Audiências de Custódia e da “Audiência Paredão” no Núcleo de Prisão em Flagrante de Salvador.

Abstract

O presente trabalho visa à análise de dados coletados através da metrologia de observação participante não estruturada para compreender a prática da Audiência de Custódia no Núcleo de Prisão em Flagrante em Salvador e a sua consonância com a Resolução de n° 213/2015 do Conselho Nacional de Justiça, bem como, à luz dos ensinamentos da Criminologia Crítica compreender as criminalizações produzidas no Núcleo, os estereótipos reproduzidos, e a atuação dos atores jurídicos em face das violações de direitos fundamentais, por fim, a pesquisa se debruça sobre o conceito da “Audiência Paredão”, seus fundamentos e características, e sua não adequação em face da Resolução do CNJ

The present work aims at the analysis of data collected through participatory observation methodology not structured to understand the practice of the Hearing of Custody in the Center of Prison in Flagrante in Salvador and its in accordance with National Council Resolution n. 213/2015 of Justice, as well as, in the light of the Critical Criminology teachings to understand the Criminalizations produced in the Nucleus, the reproduced stereotypes, and the action of the juridical actors in the face of violations of fundamental rights, finally, the research focuses on the Audience concept Paredão, its fundamentals and characteristics, and its non-adequacy in the face of the CNJ Resolution
