Abstract: | O presente trabalho tem análise a chamada mutação constitucional, com o estudo de sua origem, conceito, características e, principalmente, os limites para aplicação. Em um segundo momento, será estudado o fenômeno do ativismo, com vistas a conceituá-lo e caracterizá-lo. Após firmadas as premissas fundamentais do trabalho, o julgamento do habeas corpus 126.292/SP será examinado, ocasião em que o Supremo Tribunal Federal, sob o argumento de reconhecer uma mutação constitucional, alterou jurisprudência firmada desde de 2009 e passou a permitir o cumprimento antecipado da pena após decisão em segunda instância, muito embora o inciso LVII do artigo 5º da Constituição Federal seja taxativo ao afirmar que a culpa tem sua definitividade com o trânsito em julgado da condenação criminal, e não com julgamento em segundo grau. A análise desse julgado terá como foco a observância a respeito dos limites doutrinariamente previstos para mutação constitucional, bem como, se tais barreiras foram respeitadas pela Corte. Com isso, demonstrar-se-á que o Supremo não respeita os limites desse fenômeno, atuando em verdadeiro ativismo judicial, que é a hipótese levantada neste trabalho. The present work has analyzed the so - called constitutional mutation, with the study of its origin, concept, characteristics and, mainly, the limits for application. In a second moment, the phenomenon of activism will be studied, in order to conceptualize and characterize it. After having established the fundamental premises of the work, the judgment of habeas corpus 126,292 / SP will be examined, at which time the Federal Supreme Court, on the grounds of recognizing a constitutional change, changed jurisprudence signed since 2009 and allowed for early compliance with sentence after decision in the second instance, although clause LVII of article 5 of the Federal Constitution is exhaustive when affirming that the guilt has its finality with the final sentence of the criminal conviction, and not with a judgment in the second degree. The analysis of this trial will focus on compliance with the doctrinal limits for constitutional change, as well as whether such barriers were respected by the Court. With this, it will be demonstrated that the Supreme does not respect the limits of this phenomenon, acting in true judicial activism, which is the hypothesis raised in this work. |
