A necessidade de regulamentação ético-jurídica na reprodução humana assistida: uma análise da Omissão Legislativa Brasileira

Abstract

O presente estudo visa a analisar a disciplina normativa atual sobre o uso das técnicas de Reprodução Humana Assistida no ordenamento jurídico pátrio e se, de fato, há ou não a necessidade de maior regulamentação ético-jurídica no uso dessas técnicas, uma vez que a única previsão acerca do tema são as Resoluções do Conselho Federal de Medicina, não sendo leis propriamente ditas, mas atos corporativos dotados de força normativa e passíveis de controle pelo Poder Judiciário. Para tanto, será feita uma análise dos conceitos e das técnicas de Reprodução Humana Assistida, bem como uma análise da matéria sob o enfoque dos Documentos Internacionais de Direitos Humanos e Bioética, além de uma análise no plano constitucional acerca do planejamento familiar. Após isso, far-se-á uma verificação de como o tema é tratado no ordenamento normativo interno, com a finalidade de constatar se as normas existentes são suficientes para decidir os conflitos. Em seguida, será traçado um paralelo da legislação pátria com as previsões de Portugal e Espanha, por se tratarem de países de sistema continental latino e com legislação recente. Ao final, examinar-se-ão os projetos de lei em trâmite nas casas do Congresso Nacional e os casos emblemáticos que marcam o tema, sintetizando-se acerca de quais temas em especial mostraram-se mais carentes de detalhamento.

The present study aims to analyze the current normative discipline about the use of technics in Human Assisted Reproduction in the legal order of the country and whether, in fact, there is or not a major necessity in ethic-juridical regulation in the use of these technics, once the unique prevision about this subject are the Federal Resolutions of Medicine Council, not being law themselves, but corporative acts endowed with normative force and passable of control by the Judiciary. For this matter, an analysis of the concepts and technics of Human Assisted Reproduction will be done, as well as an analysis of the matter under the focus of the International Human Rights and Bioethics, in addition to a constitutional analysis concerning family planning. After this, a verification on how the topic is addressed in the internal normative order, with the goal to find out if the existing norms are sufficient to manage conflicts. Then, it will be traced a parallel study of the Brazilian legislation with the predictions of Portugal and Spain, because they are countries of continental latin system and with recent legislation. In the end, bills in progress in the houses of the National Congress will be evaluated and the emblematic cases that remarks the subject, synthesizing about which subjects in particular were more lacking in detail.
