Abstract

The research, of the field research type, seeks to understand the roots of the ineffectiveness of the national solid waste policy law in the city of Serrinha and how this reality can be minimized and transformed into a scenario of respect and applicability. For this purpose, public and private documents on the solid waste conjuncture in the city, the legislation in force, direct observation, and the available bibliography on the theme were studied. The research revealed the inertia of the public power and the population, in an aspect of shared responsibility, about the ineffectiveness of the law analyzed in the city. The study revealed, therefore, that the implementation of a sanitary landfill in Serrinha, although currently considered an end-of-pipe solution, is still feasible given the existence of a garbage dump in the municipality. It was verified the absence of a public consortium integrating the city, the negligence in the inclusion of the waste collectors, as well as the authorities' abstention in the elaboration of a municipal plan of integrated management of solid waste within the legal term, which may incur in revenue waiver. Finally, the participation of private initiative in the application of the law was verified. The roots of the ineffectiveness of the national solid waste policy were intrinsically linked to the capitalist life model and the thesis of nature as a subject of law was defended as one of the solutions for a greater applicability of this legislation. The environmental education of adults and children was highlighted as an important element in the law's effectiveness.
