dc.description.abstractThe present work intends to demonstrate the existence of an employment relationship between the driver of Uber Platform and the company. In order to achieve the desired goal, a historical investigation of the employer-employee relationship will be necessary, going through the different modes of production from the beginning of the twentieth century with the emergence of Fordism, the flourishing of Toyotism, to the contemporary context of the world of job. It is necessary to differentiate the relation of employment of relation of work, which legally speaking are distinctly different. Regarding the employment relationship, its main characters will be brought in, by analyzing articles 2 and 3 of CLT / 43. However, the main focus with regard to the characteristics of the employment relationship will be insubordination. Regarding the jurisprudence, an investigation will be carried out regarding the position of the Brazilian justice regarding the issue, due to the growing number of lawsuits involving the driver and UBER as litigants. To prove the subordination between the driver and the UBER company will be our challenge in this work.pt_BR

dc.description.resumoO presente trabalho pretende demonstrar a existência de relação empregatícia entre o motorista do aplicativo Uber e a empresa. Para que se possa atingir o objetivo almejado se fará necessária uma investigação histórica da relação empregado-patrão, perpassando pelos diferentes modos de produção desde o início do século XX com o surgimento do fordismo, o florescimento do Toyotismo, até o contexto contemporâneo do mundo do trabalho. Faz-se mister diferenciar relação de emprego de relação de trabalho, as quais, juridicamente falando, são sensivelmente distintas. No que tange a relação de emprego serão trazidos seus caracteres principais, realizando uma análise dos artigos 2° e 3° da CLT/43. No entanto o foco principal no que diz respeito às características da relação de emprego, será na subordinação. Quanto a jurisprudência, se realizará uma investigação quanto ao posicionamento da justiça brasileira quanto à questão, tendo em vista o crescente número de processos envolvendo como litigantes o condutor e a UBER. Comprovar a subordinação entre o motorista e a empresa UBER será nosso desafio neste trabalho.pt_BR
