Responsabilidade Civil dos fornecedores de serviços de economia compartilhada: o papel do Sistema Nacional de Defesa do Consumidor

Abstract

O presente trabalho visa abordar a problemática da responsabilidade civil nos contratos de economia compartilhada via aplicativos e websites e os métodos utilizados para resolução de conflitos na comarca de Salvador – BA. Analisar-se-á inicialmente o contexto histórico e o surgimento dessa modalidade econômica, a fim de situar o leitor acerca dos principais acontecimentos que corroboraram para o seu nascimento e consolidação. Em seguida, buscar-se-á conceituar essa nova relação de mercado, demonstrando a sua formação, os seus agentes e o seu o objeto. Por conseguinte, adentrando, no segundo capítulo, no subtema da responsabilidade civil, faz-se necessário apontar que, para compreensão de tal instituto, realizar-se-á, em primeiro lugar, a delimitação dos sujeitos envolvidos nesses trâmites negociais a fim de verificar a sua adequação aos elementos elencados pelo Código de Defesa do Consumidor como fundamentais à caracterização da relação de consumo. Por fim, no terceiro capítulo será analisada o papel do Sistema Nacional de Defesa do Consumidor e de seus agentes na promoção da proteção e educação dos consumidores no âmbito das relações de economia compartilhada

The present work deals with problem of civil responsibility in the contracts of shared economy through applications and websites and the methods used to solve conflicts in the region of Salvador - Bahia. We will first analyze the historical context and the emergence of this economic modality, in order to situate the reader about the main events that corroborated for its birth and consolidation. Next, we will seek to conceptualize this new market relation, demonstrating its formation, its agents and its object. Therefore, in the second chapter of the sub-theme of civil responsability, it is necessary to point out that, in order to understand this institute, it will be firstly the delimitation of the subjects involved in these negotiations, in order to verify its adequacy to the elements listed by the Consumer Defense Code as fundamental to the characterization of the consumption relation. Finally, the third chapter will analyze the role of the National System of Consumer Protection and its agents in the promotion and protection of consumers in the framework of shared economic relations.
