O caso dos confeiteiros devotos: o exercício da objeção de consciência religiosa por parte de fornecedores em face de consumidores homoafetivos no Brasil a partir do direito anglo-americano

Abstract

O presente trabalho trata da problemática atinente visa analisar o tema da eficácia dos Direitos Fundamentais nas Relações de Consumo, especificamente, busca estudar a aplicabilidade e o uso da objeção de consciência nos contratos de compra e venda de bolos. Assim, a hipótese central levantada considera ser possível o exercício da escusa de consciência em face de consumidores conforme questão apresentada. O objetivo principal da pesquisa, assim, refere-se ao aparente choque dos direitos fundamentais entre a liberdade de consciência e crença religiosas em face da proteção e defesa dos consumidores homoafetivos e como solucioná-lo. Como objetivos específicos, buscar-se-á analisar como tal cláusula de consciência religiosa pode ser entendida no Brasil, a partir de suas raízes históricas e sociológicas, da revisão bibliográfica da literatura jurídica brasileira e estrangeira acerca do instituto, como os demais Poderes apreciam e/ou regulamentam tal problema e qual a atual situação dos consumidores homoafetivos. No que se refere à metodologia, Utilizar-se-ão, no presente trabalho, como métodos científicos os de indução e dedução. No que diz respeito ao método jurídico, empregar-se-ão os métodos hermenêutico e argumentativo. No que tange ao método sociológico serão adotados os procedimentos monográficos e estudo de caso. A linha será a crítico-metodológica. Optou-se pela utilização dos segundos: jurídico exploratório, jurídico-projetiva e jurídico-propositiva. O modelo teórico metodológico será o jurídico sociológico. Ao tipo de pesquisa, aplicar-se-á o exploratório. Elegeu-se como procedimentos técnicos, o bibliográfico e o documental. A natureza da abordagem será a pesquisa aplicada. E, por fim, a forma de abordagem será qualitativa. Com tal abordagem, o primeiro capítulo analisa dois precedentes da jurisdição constitucional comparada similares à situação problema disposta. No segundo, pesquisa-se o instituto da objeção de consciência religiosa, além de seus conceitos e normatização no Direito brasileiro. Após, no terceiro capítulo, estuda-se a condição do consumidor homoafetivo e as relações deste com o microssistema de proteção e defesa do comércio de produtos e serviços. Em seguida, feitas estas considerações, investiga-se a problemática específica à luz do Direito Civil Constitucional Contemporâneo sendo apresentada resposta à luz dos marcos teóricos selecionados, que ao máximo compatibilização os direitos fundamentais em conflito na problemática.

The present work deals with the problematic of the subject of the effectiveness of the Fundamental Rights in Consumer Relations, specifically, it looks for to study the applicability and the use of conscientious objection in the agreements of purchase and sale of cakes. Thus, the central hypothesis raised asks if it is possible to exercise conscientious objection in the face of consumers according to the presented question. The main objective of the research, therefore, refers to the apparent clash of fundamental rights between freedom of religious conscience and belief in the face of protection and defense of homoafetivos consumers and how to solve it. The specific objectives will seek to analyze how such a clause of religious conscience can be understood in Brazil, from its historical and sociological roots, from the bibliographical revision of the Brazilian and legal literature about the institute, how the other Branchs appreciate and / or regulate such problem and what is the current situation of the homossexual consumers in Brazil. Regarding the methodology, the present work will be used as the scientific methods of induction and deduction. With regard to the legal method, the hermeneutic and argumentative methods will be used. Regarding the sociological method will be adopted the monographic procedures and case study. The line will be critical-methodological. Was opted for the use of the latter: exploratory legal, juridical-projective and legal-propositional. The theoretical methodological model will be the juridical sociological. The exploratory type will be applied to the type of search. It was chosen the technical procedures, bibliographical and documentary. The nature of the approach will be applied research. And, finally, the approach will be qualitative. With such an approach, the first chapter examines two precedents of comparative constitutional jurisdiction similar to the problem situation set forth. In the second one, the institution of the objection of religious conscience is investigated, besides its concepts and normatization in Brazilian Law. After, in the third chapter, the condition of homoaffective consumer and the relations of this with the microsystem of protection and defense of the commerce of products and services are studied. After considering these points, the specific problem is investigated in the light of the Contemporary Civil Constitutional Law, being solved in the light of the selected theoretical frameworks, that to the maximum compatibilization the fundamental rights in conflict in the problematic
