O embrião não implantado: um nascituro?

Abstract

A presente monografia trata de um estudo sobre a natureza jurídica do embrião in vitro e seus direitos inerentes. Na atual era do progresso tecno-científico, o Direito positivo não é capaz de regular pari passu as alterações realizadas. Esse fato é visível na ausência de um tratamento explícito sobre os direitos e garantias do produto da fertilização assistida. Nesse aspecto, coube ao presente trabalho analisar se o embrião é equiparável ao nascituro, ou se a viabilidade – aptidão para vida – é uma característica intrínseca somente ao primeiro, cabendo ao segundo uma natureza sui generis, consoante julgamento da ADI 3510. Ademais, também foram objeto de estudo os direitos e garantias a eles vinculados em razão de sua origem genética humana e da transcendência do princípio da dignidade da pessoa humana. Quanto a esse tópico, foi oferecida especial atenção à disposição da Resolução n° 2.168 do Conselho Federal de Medicina no que tange à reprodução artificial.

This monograph deals with a study on the legal nature of the embryo in vitro and its rights. In the current era of techno-scientific progress, Positive Law is not able to regulate pari passu the new reality. This fact is visible in the absence of an explicit treatment on the rights and guarantees of the embryo. In this aspect, the present work analyzes the nature of the embryo in vitro, if it is identical to the one of the fetus or not. At this point, viability - or fitness for life - was used as a distinguishing feature of the unborn and the embryo. In addition, rights and guarantees regarding the embryo were perceived because of their genetic origin and the dignity of the human person. Regarding this topic, special attention was given to the provision of Resolution N. 2,168 of the Brazilian Federal Medical Council (CFM) regarding artificial reproduction.
