Famílias simultâneas: possibilidade de reconhecimento jurídico na nova concepção brasileira de famílias

Abstract

O presente trabalho cumpre a instigante tarefa de investigar um modelo de arranjo familiar bastante peculiar. As famílias simultâneas ou uniões estáveis paralelas, verdadeiro fenômeno social, começa a aflorar na dinâmica das relações de afeto, apesar de não regulada por qualquer disposição legal. Diante da investigação histórica, até a compreensão mais atual das concepções de família, nota-se que valores antes absolutos, como sacralidade e monogamia das relações afetivas, começam a deixar espaço para um novo objetivo da família, qual seja a satisfação afetiva. Com isso, através da pesquisa documental e bibliográfica, além de apurada análise de decisões judiciais, busca esse trabalho justificar a possibilidade jurídica do reconhecimento desta família plural. Além da reflexão baseada nos princípios constitucionais atinentes ao direito de família, cumpre advertir aos operadores do direito, principalmente os julgadores, quanto à necessidade de adequar a aplicação da lei às realidades do caso concreto, de sorte que o direito não mais esteja aquém das mudanças experimentadas pela realidade social, variações estas que devem ser amparadas sempre que não estejam incompatíveis com a dignidade humana e demais valores fundamentais protegidos pela ordem constitucional.

This work serves the thought-provoking function of investigating the rather peculiar family arrangement model. Simultaneous families or parallel stable unions, a true social phenomenon, begins to emerge in the dynamics of affective relationships, although not regulated by any legal provision. Faced with historical investigation, until the most current understanding of the conceptions of family, it is verified that values that before were absolute, such as the sacredness and monogamy of family rules, begin to give room for a new family purpose, the affective function. With this, through documentary and bibliographical research, besides an accurate analysis of judicial decisions, this work seeks to justify the juridical possibility of the recognition of this plural family. In addition to the reflection based on the constitutional principles of family law, we warn that jurists, especially the judges, on the need to adapt the application of the law to the realities of concrete cases, so that the law no longer falls short of the changes experienced by reality These variations must be protected whenever they are not incompatible with human dignity and other fundamental values protected by the constitutional order
