A Proteção do consumidor em face dos jogos eletrônicos para celulares: A ausência de informações, a violação à boa-fé objetiva e a busca de soluções

Abstract

Este trabalho trata da análise de jogos eletrônicos para celulares visando aferir a conformação desses serviços aos ditames consumeristas, especificamente quanto aos princípios da informação e da boa-fé objetiva. A hipótese aventada era de que tais direitos estavam sendo violados e os objetivos da pesquisa era verificar eventuais transgressões, bem como sugerir soluções para os problemas verificados. Seguindo a linha crítico-metodológica, realizou-se uma investigação jurídico-diagnóstica e propositiva. Os dados foram colhidos a partir da observação direta e a abordagem da pesquisa foi tanto quantitativa quanto qualitativa. Foi realizado um estudo de campo com quatorze aplicativos da categoria, bem como um levantamento através de questionário destinado aos consumidores. Também se realizou pesquisa documental referente aos termos de uso dos jogos. Obtido esse material, procedeu-se com a pesquisa bibliográfica para processá-lo adequadamente, observando a existência ou não de eventuais violações. O segundo capítulo deste trabalho apresentou e analisou os dados, o terceiro identificou a relação de consumo, o quarto analisou as implicações jurídicas e as violações observadas e o quinto propõe soluções para enfrenta-las. Sendo estas comprovadas, foram sugeridas soluções com espeque nos diplomas legais existentes, bem como alterações ao ordenamento. Tais modificações perpassam, também, pela celebração de tratados e a autorregulação do mercado.

This paper deals with the analysis of electronic games for cell phones, and aims to assess the conformation of such services to the norms of Consumer’s Law, especially in relation to the principles of information and objective good faith. The hypothesis proposed was that those rights were being violated, and the objectives of the research were to verify eventual transgressions, as well as to suggest solutions to the verified problems. In accordance with the critical methodological approach, a legal-diagnostical and propositional investigation was conducted. The data was collected through direct observation. It was conducted a field survey with fourteen applications within the category, as well as a data collection through a questionnaire for consumers. It was also conducted a documental research in reference to the terms of use of such games. Once this material was obtained, it was conducted a bibliographical research in order to properly process it, observing the existence or non-existence of violations. The second chapter of this paper presented and analyzed the data, the third one defined what is a consumer relationship, the fourth assessed the legal consequences and the observed violations, and the fifth one proposes solutions to face it. Since these violations were verified, it was suggested solutions based on the current legal norms in force, as well as changes to the law system. Such modifications include, also, the accession to treaties and the market self-regulation.
