Lei 13.491/17: dos efeitos penais e Processuais Penais Militares e do uso e tráfico de drogas em lugar sujeito à administração militar

Abstract

O presente trabalho tem por escopo analisar as mudanças ocorridas noDireito Penal Militar após a entrada em vigor da Lei 13.491.17, que alterou o art. 9° do Código Penal Militar, dispositivo responsável por delinear o que se considera crime militar em tempo de paz.As mudanças legais promovida pela novel Lei se dividem em duas: a) ampliação do rol de crimes militares, que não mais se limitam aos previstos no CPM; b) competência nos casos de crimes dolosos contra a vida de civis cometidos por militares das Forças Armadas. Ambos os temas serão abordados neste trabalho, dando-se especial atenção à possibilidade de que os tipos previstos na legislação penal (o que inclui a extravagante)sejam considerados crimes militares. Nesse contexto, necessário discutir o aparente conflito entre a Lei 11.343/06 (Lei de Drogas) e o art. 290 do CPM( que prevê o tipo de Tráfico, posse ou uso de entorpecente ou substância de efeito similar)nos casos relacionados ao uso e tráfico de drogas em lugar sujeito à administração militar, dada a atualidade do tema, bem como pela sua importância prática,ante a expressiva quantidade de casos que envolvem tais condutas no âmbito da Justiça Militar.

The present work has the scope to analyze the changes that have occurred in the Military Penal law after come into of the Law 13.491/17, which changed ther art. 9 of the Military Penal Code the device responsible for outlining what is considered a crime in the military in time of peace. The legal changes promoted by the new Law are divided into two; a) eansion of the list of military crimes, that it is not limited to those provided in the MCP; b) jurisdiction in cases of crimes against civilians committed by armed forces military. Both topics will be addressed in this work, giving special attention to the possibility that the provided for in criminal law (which includes the extravagant) are considered military crimes. In this context it is necessary to discuss the apparent conflict between the Law 11.343/06 (drug law) and the art. 290 of the Military Penal Code(which provides the type of trafficking possession or use of narcotic or substance of similar effect) in the cases related to the use and trafficking of drugs in a place subjected to Militay administration given the topicality of the theme, as well as for its practical importance, compared with the significant amount of cases involving such conduct in the context of Military justice.
