A alienação parental e a síndrome de alienação parental: um debate relevante

Abstract

Este trabalho busca abordar as transformações no conceito de família no ramo do Direito de Família, visando maior compreensão e análise crítica do fenômeno da Alienação Parental e a Síndrome de Alienação Parental, temas que tem ganhado, nos últimos anos, considerável atenção da doutrina nacional e internacional. Pretende-se estudar a diferenciação entre as práticas que configuram a Alienação Parental e a síndrome que desta resulta, qual seja, a Síndrome de Alienação Parental, como forma de planejar ações legais e terapêuticas eficazes ao tratamento das crianças vítimas de ambos fenômenos, resultantes, sobretudo, dos conflitos que envolvem disputas judiciais pela guarda da criança. Pretende analisar também as contribuições trazidas pela Lei 12.318/10 no que diz respeito aos instrumentos que os operadores do Direito dispõem para identificar as práticas de Alienação Parental e responsabilizar aqueles que induzem a Síndrome de Alienação Parental na criança

This work intends to approach the transformations in the concept of family in the area of Family Law, in order to better comprehend and critically understand the phenomenon of Parental Alienation and Parental Alienation Syndrome, themes that have gained, over the years, considerable attention of the national doctrine as well as the international. Intends to study the differentiation between the acts that configures the Parental Alienation and the syndrome that comes as a result, that being the Parental Alienation Syndrome, as a form of planning effective legal and therapeutical actions in the treatment of the children who are victims of both phenomenons, that arises mostly as a result of conficts involving judicial battles for the child’s guard. It will also analyse the contributions brought by the law 12.318/10 regarding the tools that the professionals of the law have to identify the acts of parental alienation and to hold on accountable those who induce the parental alienation syndrome in the child.
