O Reconhecimento do vínculo de multiparentalidade

Abstract

Trata a presente monografia acerca da multiparentalidade e do reconhecimento desse fenômeno jurídico diante dos conflitos relacionados a paternidade de um só indivíduo por diferentes genitores. Objetivou-se, desse modo, verificar a possibilidade de identificação de múltiplos vínculos filias não apenas quando há vontade harmônica de todos os envolvidos, bem como nas situações em que não é desejo do ascendente genético reconhecer a parentalidade, por meio do vínculo biológico, de filho que já possui pai socioafetivo, cabendo o mesmo às relações maternas. Analisou-se nos capítulos a nova concepção de família e seus princípios norteadores, os diferentes vínculos filiais, e o desenvolvimento da multiparentalidade no Brasil através da análise de três processos que retratam diferentes situações que ensejaram ao reconhecimento da multiparentalidade. Examinou-se também o Recurso Extraordinário 898.060 julgado pelo Supremo Tribunal Federal, em setembro de 2016, com repercussão geral reconhecida, sob relatoria do Ministro Luiz Fux por constituir importante precedente sobre o tema da multiparentalidade.

The presente monograph addresses the multiple parenthood and the recognition of this legal phenomenon in face of the related conflicts about paternity of one single individual by different parents. Thus, the goal was to verify the possibility of identification of multiple daughterly bonds not only when there is harmonic will of everyone involved, but also in those situations on which it is not desired by the genetic ascending to recognize the parenting, through biological link, of a son that already possesses a socio-affective father, likewise with maternal relations. The new conception of family and it’s guiding principles were analyzed throughout the chapters, as were the different daughterly bonds and the development of multiple parenthood in Brazil by reviewing three setenced trials that portray distinct situations which caused the acknowledgment of multiple parenthood. Furthermore, the Extraordinary Resource number 898.060 judged by the Federal Supreme Court, in September of 2016, with recognized general repercussion, under the rapporteur of the Minister Luiz Fux was examined for constituting an important precedent about the multiple parenthood subject.
