Operação Lava Jato: violação aos Princípios Constitucionais, garantias fundamentais sob ameaça e o enfraquecimento do Estado Democrático de Direito

Abstract

Esta monografia tem como principal objetivo analisar a delação premiada, sua origem, sua consolidação e de que forma os diversos Ordenamentos Jurídicos tratam este instituto jurídico. A análise se estende a forma como o mau uso da delação premiada fere Direitos Fundamentais e enfraquece o Estado Democrático de Direito uma vez que a obtenção da delação não pode e não deve comprometer a eticidade do Estado, que deve ser agente responsável por induzir comportamentos éticos aos cidadãos. A má condução estatal importa forte impacto na sua credibilidade junto a coletividade uma vez que gera insegurança e desconfiança por parte da população que deve confiar no Estado e nas suas instituições. Na medida em que o Estado compromete a dimensão ética para obter sucesso no combate a criminalidade, pode comprometer também a sua própria existência e deixar de ser referência para o cidadão. O direito a de se manter em um nível acima dos jurisdicionados e isento de estratagemas vis de persecução penal, sob pena de se igualar aos infratores que pretende punir. O combate a criminalidade deve ser sim eficaz, mas os fins não justificam os meios e cabe ao Estado qualificar seus quadros e instituições para que o combate ao crime organizado seja feito em obediência aos ditames legais e sob o signo da Constituição Federal sem que nenhum dos seus Princípios seja violado ou ameaçado. Será analisada a violação de Direitos e Garantias inerentes à pessoa humana. O trabalho objetiva demonstrar que a delação premiada, como está sendo usada atualmente no Brasil, ofende Princípios Constitucionais e enfraquece o Estado Democrático de Direito, especialmente no âmbito da operação lava jato onde a delação premiada foi utilizada diversas vezes e onde estas ofensas se evidenciaram e se tornaram de domínio do grande publico uma vez que a presunção de inocência, o devido processo legal, a dignidade da pessoa humana e o principio do juiz natural foram fragilizados e violentados em nome do combate a corrupção. A violação das Garantias Fundamentais expõe a fragilidade da, ainda jovem, democracia brasileira e de como a sociedade flerta com o Estado de Exceção onde garantias e direitos são transformados em moeda e se funda uma elevada insegurança jurídica.

This monographie has as main objective to analyze the awarded aelation, its origin, its consolidation and how the different Legal Orders deal with this Legal Institute. The analysis extends to the way in which the misuse of Award Winning violates Fundamental Rights and weakens the Democratic State of Law since the obtaining of the delation can not and should not compromise the ethics of the State that must be responsible agent to induce ethical behavior to the Citizens. The bad state conduction has a strong impact on its credibility with the community since it generates insecurity and distrust on the part of the population that must trust the State and its Institutions. As the State commits the ethical dimension to succeed in fighting crime, it can also compromise its own existence and cease to be an ethical reference for the citizen. The right to remain at a moral level above the jurisdiction and free of criminal stratagems of criminal prosecution, otherwise it will be equal to the offenders that it intends to punish. The fight against crime must be effective but the ends do not justify the means and it is up to the State to qualify its cadres and institutions so that the fight against organized crime is done in obedience to the legal dictates and under the sign of the Federal Constitution without any of its Be violated or threatened. The mitigation of Human Rights and Guarantees will be analyzed. The objective of this paper is to demonstrate that the awarding of an offense offends constitutional principles and offends the democratic state of law, especially in the scope of the jet lag operation, where the Award Winning was used several times and where these legal aberrations were evidenced and became a domain of the great public one The presumption of innocence, due process of law, the dignity of the human person and the principle of the natural judge were weakened and violated in the name of combating corruption.
