O papel da fiscalização na efetividade da lei de estágio

Abstract

Este trabalho analisa o papel da fiscalização na lei 11.788 de 25 de dezembro de 2008, busca-se demonstrar uma possível falha na fiscalização que possa ensejar no descumprimento dos requisitos formais e materiais da lei de estágio, o que ocasiona em diversas fraudes praticadas pela parte concedente. Essa relação possui uma base triangular formada pela instituição de ensino, parte concedente e o estudante com a intervenção dos agentes de integração, dessa forma é detalhado neste trabalho a função e as obrigações de cada uma das partes que estão presente no termo de compromisso. Por meio de uma pesquisa de campo realizada com 30 estudantes de diversos cursos da Universidade Federal da Bahia foi possível analisar os pontos de ineficácia desta lei, abordando a fragilidade na fiscalização realizada pelo Ministério do Trabalho e Emprego. Apresentado o problema da fiscalização e da efetividade da lei de estágio, foi possível então abordar o estágio com um olhar propositivo, apresentando soluções viáveis para o combate do desvirtuamento da relação de estágio e as possíveis fraudes ocasionadas por uma fiscalização ineficiente.

This paper analyzes the role of supervision in Law 11.788 of December 25, 2008, It is sought to demonstrate a possible failure in the inspection that may lead to noncompliance with the formal and material requirements of the statute law, which results in several frauds committed by the granting party. This relationship has a triangular basis formed by the educational institution, granting party and the student with the intervention of the integration agents, so it is detailed in this work the function and the obligations of each of the parties that are present in the term of commitment. Through a field survey conducted with 30 students from various courses of the Federal University of Bahia, it was possible to analyze the deficiencies of this law, addressing the fragility in the inspection carried out by the Ministry of Labor and Employment. Given the problem of supervision and the effectiveness of the probation law, it was possible to approach the probationary stage with a proactive approach, presenting feasible solutions to combat the distortion of the traineeship relationship and possible fraud caused by inefficient supervision.
