Análise das principais práticas abusivas do Sistema de Assistência à saúde dos Servidores Públicos estaduais da Bahia (Planserv): aplicação do Código de Defesa do Consumidor

Abstract

O presente trabalho de conclusão de curso analisa as principais cláusulas abusivas impostas pelo Sistema de Assistência à Saúde dos Servidores Públicos Estaduais da Bahia (PLANSERV) e a incidência do micros sistema consumerista sobre o plano. Contemplou-se, como hipótese central, se o referido seguro pratica condutas abusivas e a necessidade da aplicação do Código de Defesa do Consumidor ao convênio. Desta conjuntura, objetivou-se identificar a abusividade de determinadas disposições do fornecedor. Para tanto, os métodos utilizados foram o hipotético dedutivo, o argumentativo. Em outro capítulo, realizou-se uma revisão doutrinária acerca do conceito das cláusulas abusivas, destacando o rol exemplificativo trazido pela legislação consumerista. Por último, mas não menos importante, apresentou-se soluções ao enfrentamento das práticas abusivas, por meio do controle judicial e administrativo, inserindo-se neste, especialmente a atuação do Ministério Público, bem como a aplicação, por analogia, da Lei nº 9.656/98 da fiscalização da Agência Nacional de Saúde Suplementar. Concluiu-se, através da pesquisa jurisprudencial, documental e bibliográfica, que o PLANSERV fixa a seus usuários condições mais onerosas, que desequilibram a relação contratual, levando os mesmos a buscar estratégias extrajudiciais e judiciais para solução do conflito.

The present work of course conclusion analyzes the main abusive clauses imposed by the State Health Service System of Bahia (PLANSERV) and the incidence of the consumer micro-system on the plan. It was considered, as a central hypothesis, whether this insurance practices abusive conduct and the need to apply the Consumer Defense Code to the agreement. From this context, the objective was to identify the abuse of certain provisions of the supplier. For that, the methods used were the hypothetic-deductive, the argumentative. In another chapter, a doctrinal review was carried out on the concept of unfair terms, highlighting the exemplary role brought by consumer legislation. Last but not least, solutions were presented to coping with abusive practices, through judicial and administrative control, inserting itself in this, especially the Public Prosecution Service, as well as the application, by analogy, of Law no. 9.656/98 of the supervision of the National Agency of Supplementary Health. It was concluded, through the jurisprudential, documentary and bibliographic research, that PLANSERV fixes to its users more costly conditions, which unbalance the contractual relationship, leading them to seek extrajudicial and judicial strategies for the resolution of the conflict.
