Entre oportunidades e moblizações: o processo político de desenvolvimento da pauta dos direitos LGBTI na agenda da ONU desde a articulação das redes transnacionais de ativismo

Abstract

Desde a década de 1990, acompanhamos a maior participação das Organizações Não Governamentais (ONG) nas discussões de pautas em direitos humanos no âmbito da Nações Unidas (ONU). A realização de Conferências internacionais possibilitou a efervescência de novas pautas na organização. É nesse período que ONGs e movimentos sociais de Lésbicas, Gays, Bissexuais, Transgêneros e Intersexos (LGBTI) passaram a se mobilizar pela inserção de seus direitos na agenda da organização. Atenta a isso, a presente dissertação objetiva compreender como se desenvolveu esse processo político de formação da agenda na ONU, de modo estrito, desde a criação do Conselho de Direitos Humanos (CDH) até 2019, ano da renovação do mandato do Especialista Independente sobre orientação sexual e identidade de gênero. Essa indagação será norteada pelo modelo analítico de agenda-setting desenvolvido pela Jutta Joachim, através da sistematização de abordagens sobre movimentos sociais e formação de agenda, que nos auxilia a analisar a articulação política desde as redes transnacionais de ativismo LGBTI. Através da pesquisa, também buscamos analisar o mandato do Especialista Independente e como a pauta LGBTI é mobilizada na Revisão Periódica Universal e nos casos individuais nos órgãos de tratado. Observaremos também como se organizaram os Estados-membros favoráveis e contrários à pauta e quais foram os enquadramentos interpretativos empreendidos por eles e pelas redes transnacionais. Para tanto, nos valeremos de revisão bibliográfica e métodos qualitativos de pesquisa, através da análise documental de relatórios, resoluções e declarações da ONU e de ONGs.

Since the 1990s, we have followed the greater participation of Non-Governmental Organizations (NGOs) in discussing human rights at the United Nations (UN). The specialized conferences enabled the rising of new agendas in the organization. During this period, NGOs and social movements of Lesbians, Gays, Bisexuals, Transgender and Intersex (LGBTI) started to mobilize for the insertion of their rights in the organization's agenda. Aware of this, the present dissertation aims to understand how this political process of agenda setting at the UN developed, especially from the creation of the Human Rights Council (HRC) until 2019, when the mandate of the Independent Specialist on orientation sexuality and gender identity was renewed. This question will be guided by the theoretical framework of agenda setting developed by Jutta Joachim through the systematization of approaches on social movements and agenda setting. It helps us to analyze the political articulation from the transnational advocacy networks perspective. Through this research, we also aim to analyze the mandate of the Independent Expert and how the LGBTI agenda is mobilized in the Universal Periodic Review and in individual cases in treaty bodies. We will also observe how the Member States in favor of or against the agenda were organized and which frames were created by them and by the transnational networks. As methodology, we will use bibliographic review and qualitative research methods, through document analysis of reports, resolutions and statements by the UN and NGOs.
