Delinquência juvenil e a criminalidade adulta: Uma análise à luz do estatuto da criança e do adolescente

Abstract

A pesquisa visa analisar a problemática vivida em todas as cidades Brasil, em especial os grandes centros urbanos: o vínculo da segurança pública com a justiça juvenil-JJ. A pesquisa aprofundou-se neste tema para saber se existe algum nexo de causalidade dentre os altos índices de criminalidade atuais com a iniciação delituosa na menor idade. O Estatuto da Criança e do Adolescente –ECA –foi estudado especificamente o rol taxativo de medidas socioeducativas com previsão no artigo 112, com o designío de elucidar o motivo de mesmo o sistema judiciário dispondo de um diploma legal tão bem elaborado, contemplativo e premiado internacionalmente, ainda assim, não consegue conter a progressão infracional de jovens e adolescente até a maior idade criminal. Outros estudos científicos atinentes ao ECA foram analisados, todos possuindo em seu núcleo a aplicabilidade e eficácia resolutiva das medidas sócio educativas, enriquecendo, assim, a análise sobre o tema e corroborandocom as proposições aventadas ao desfechoda pesquisa.Fazendo uso da metodologia qualitativa da história oral, mais comumente conhecida como história de vida, pretendeu-se buscar a exploração de uma realidade que não pode ser quantificada em variáveis, mas somente sentida com a verbalização dos entrevistados com relação a sua biografia.Apesquisa empírica ocorreu na Unidade Prisional Lemos Britto, localizado na Mata Escura na cidade de Salvador na Bahia. Todas entrevistas deram-se de maneira voluntária -conforme preconiza a metodologia escolhida -detentos que iniciaram sua vida delituosa na infância ou na adolescência por motivos adversos. Se buscou compreender a dinâmica das relações que se estabeleceram ao longo da existência delitiva dos entrevistados, os reais motivos que o levaram a iniciação dos atos infracionais, se houve alguma intervenção de ordem estatal, familiar ou social –ou ao menos tentativa de -e por qual motivo o entrevistado manteve-se nessa prática adentrando na fase de maior idade cometendo crimes de maior potencial ofensivo.A exploração informativa dos processos que motivaram o encarceramento de cada entrevistado proporcionou traçar um paralelo sobre sua iniciação delituosa quando menor de idade, com a atual conduta criminal na maior idade. Ao fim da pesquisa expediu-se considerações com base no empirismo do estudo, que deixou às claras qual o interesse do estado com a temática, quais os problemas relacionados com a questão dajustiça juvenil, bem como todos os atores envolvidos na indagação e, primordialmente, se existe alguma ligação, ainda que superficial, dentre a delinquência juvenil e a criminalidade adulta.

The research aims at analyzingthe problems faced by all Brazilian cities, especially the major urban centers: the link between public security and juvenile justice. The research has gotten deepen at that issueto verifyif there is any causal linkage amongthecurrent high crime rates andcriminal initiation at the youngest age. The Statute of the Child and Adolescent -SCA-was specifically studied the taxative role of socio-educational measures provided for in article 112, with the purpose of eluci-dating the reason for even the judicial system having a legal diploma so well elabo-rated, contemplative and internationally awarded, still, cannot contain the infraction progression of adolescents and young people until the greater criminal age. Other scientific studies related to the SCAwere analyzed, all of them having at their core the applicability and resolutive effectiveness of the socio-educational measures, thus enriching the analysis on the theme and corroborating with the propositions proposed for the outcome of the research. Making use of the qualitative methodology of oral history, more commonly known as life history, wehavesought to explore a reality that cannot be quantified in variables, but only felt with the verbalization of the interview-ees in relation to their biography. The empirical research was carried out at the Lemos Britto Prison, located in Mata Escura, in the city of Salvador, Bahia. All inter-views were conducted on a voluntary basis -according to the methodology chosen -inmates who began their criminal life in childhood or adolescence for adverse rea-sons. It was sought to understand the dynamics of the relations that were established during the delirious existence of the interviewees, the real motives that led to the ini-tiation of the infractions, if there was any intervention of a state, family or social order -or at least attempt to -and by Which reason the interviewee remained in this prac-tice entering the phase of greater age committing crimes of greater potential offen-sive. The informative exploration of the processes that motivated the incarceration of each interviewee provided a parallel to his criminal initiation when a minor, with the current criminal conduct at the greatest age. At the end of the research, considera-tions were made based on the empiricism of the study, becomingclear the state's interest in the subject, the problems related to the juvenile justice issue, as well as all the actors involved in the inquiry and, primarily , If there is any connection, albeit su-perficial, between juvenile delinquency and adult crime.
