A relação paciente-médico para além da perspectiva consumerista: uma proposta para o contrato de tratamento

Abstract

A presente dissertação busca contribuir para a emancipação dos pacientes, enquanto sujeitos de direito portadores de dignidade humana, bem como para a formação do Direito Médico como um ramo jurídico autônomo no ordenamento jurídico brasileiro, a partir da identificação da natureza jurídica da relação estabelecida entre paciente e médico quando em um ato terapêutico ou diagnóstico. Para tal, com base numa fundamentação bioéticae na teoria do agir comunicativo,sugere-se a positivação de uma nova figura contratual -o contrato de tratamento, resultado da evolução da autonomia do paciente no correr da história, que, à semelhança do que já vem ocorrendo em outros países, favorecerá o entendimento e o exercício dosdireitos e deveres das partes envolvidas na avença em questão. Sobretudo, favorecendo o paciente no exercício do direito sobre seu bem-estar biopsicossociale contribuindo para uma apreciação mais justa e adequada da responsabilidade civil médica.

The following theses aims to reflect uponthe emancipation of patients, as subjects of law bearing human dignity, as well as for the formation of Medical Law as an autonomous legal branch in the Brazilian legal system, from the identification of the legal nature of the relationship established between patient and physician when in a therapeutic or diagnosis act. To do this, based on a bioethical foundation and on the theory of communicative action, the suggestion is made that a new contractual figure -the treatment contract, as a result of the evolution of patient autonomy in the course of history, that has already occurred in other countries, will favor the understanding and exercise of the rights and duties of the parties involved in this contract. Above all, favoring the patient in the exercise of the right to their biopsychosocial well-being and contributing to a more fair and adequateappreciation of medical civil liability.
