Teletrabalho e a lei 13.467: regulamentação, meio ambiente laboral e responsabilidade do empregador

Abstract

Este trabalho acadêmico de monografia objetivou a análise da regulamentação do teletrabalho pela “Reforma trabalhista”, observando as ocorrências e impactos nas condições ambientais laborais, e as consequências na saúde física e psíquica do trabalhador. Com isso avaliou os pontos positivos e negativos do teletrabalho, bem como abordou o contexto de surgimento do instituto do teletrabalho. Ademais, trouxe alguns conceitos conexos ao tele-emprego, e a caracterização e os requisitos desta modalidade laboral. Para tanto, a presente monografia perpassou pela seara dos direitos fundamentais, e da sua respectiva eficácia e concepções, bem como que abarcou as normas internacionais sobre os assuntos tratados neste trabalho acadêmico (meio ambiente laboral e o teletrabalho em si), especificamente as normas portuguesas e francesas, e também a perspectiva da OIT. Com isso, este trabalho científico abordou a questão da vedação ao retrocesso social, a fim de embasar a responsabilidade do empregador, nos acidentes e doenças laborais, ocorridos no âmbito do teletrabalho, independente da existência de “termo de responsabilidade” assinado pelo empregado

This academic work of monograph aimed the analysis of the regulation of the telework by the “Labor Reform”, observing the occurrences and impacts in the environmental conditions of the work, and the consequences in the worker's physical and psychic health. By this, evaluated the positive and negative points of the telework, as well as it approached the context of appearance of the institute of Telework. Besides, it brought some related concepts of the Telework, and the characterization and the requirements of this work modality. For this purpose, the presente monograph passed by the field of fundamental rights, and the respective effectiveness and conceptions, as well as it embraced the internacional norms about the subjects treated in this academic work (work enviroment and the tekework itself), specifically the Portuguese and French standards, and the perspective of the ILO.With that, this scientific work approached the matter of the prohibition of the social retreat, in order to base the responsability of the employer, in the acidents and diseases of work, happened in the extend of the telework, independent of the existence of a “term of responsability” signed by the employee
