Abstract: | A substituição tributária para frente é uma técnica de arrecadação que representa a conjugação de duas figuras jurídicas: a substituição tributária em si e a cobrança antecipada de tributo antes da ocorrência do fato gerador. A primeira prescreve que um terceiro (substituto) estranho àquele que praticou o fato gerador (contribuinte), deva recolher aos cofres do erário o tributo devido por ele (substituto) em razão do fato gerador praticado pelo contribuinte substituído. Já a segunda preceitua que o tributo seja cobrado em uma fase preliminar à
ocorrência do fato gerador, desde que exista um vínculo capaz de garantir que o fato gerador virá a ocorrer no futuro. O presente trabalho tem o escopo de analisar a constitucionalidade e os limites da aplicação desta técnica de arrecadação, esmiuçando os argumentos favoráveis e
contrários à sua implementação, bem como as decisões proferidas pelo Supremo Tribunal Federal. Será feita uma ponderação entre a praticidade na fiscalização, decorrente da utilização de tal técnica de arrecadação, com os princípios constitucionais de Direito
Tributário que formam o núcleo de garantias individuais do contribuinte, com o fito de se concluir se é constitucional a sua instituição, bem como, caso admitida, quais são os limites
constitucionais para a sua aplicação e implementação, identificando-se os tributos afeitos à utilização desta técnica de arrecadação. The tax substitution forward is a collection technique that represents the combination of two legal figures: the tax substitution itself and the early collection of tax before the occurrence of the generating event. The former prescribes that a third (substitute) alien to the one who practiced the taxable event, should collect from the treasury coffers the tax owed by him (substitute) due to the taxable event practiced by the substituted taxpayer. The second rule is that the tax is charged at a preliminary stage to the occurrence of the generating event, provided there is a link capable of ensuring that the generating event will occur in the future. The present work has the scope to analyze the constitutionality and limits of the application of this collection technique, analyzing the arguments favorable and contrary to its implementation, as well as the decisions rendered by the Federal Supreme Court. A weighting will be made between the practicality of the inspection, resulting from the use of such collection technique, with the constitutional principles of Tax Law that form the core of the taxpayer's individual guarantees, in order to conclude whether his institution is constitutional, and as, if admitted, what are the constitutional limits for its application and implementation, identifying the taxes charged to the use of this collection technique. |
