Atuação das Cortes Internacionais na Implementação do Acordo de Paz na Colômbia

Abstract

Este trabalho monográfico, tratará sobre o tema “Atuação das Cortes Internacionais na Implementação do Acordo de Paz na Colômbia” e objetiva abordar as possíveis problemáticas advindas do Acordo de Paz realizado entre as FARC e a Colômbia, na hipótese de contrariar tratados internacionais de proteção aos direitos humanos. Deste modo, após uma breve e necessária explanação histórica, serão apresentadas a estrutura e funcionamento das Cortes Internacionais que possuem Jurisdição sobre aquele Estado-membro. Em seguida, passa-se ao problema, ou seja, a análise das situações específicas, e a partir das disposições legais dos tratados e Jurisprudência, chegar as conclusões se realmente o Pacto de Paz está em desacordo com o Direito Internacional, representado pelo Sistema Interamericano de proteção aos Direitos Humanos e Tribunal Penal Internacional, e caso se chegue a constatação de descumprimento, buscar-se-á responder como estas Cortes Internacionais de proteção aos Direitos Humanos podem intervir, com fins de defesa dos seus preceitos e das vítimas do conflito armado.

This final paper will address the theme "International Court proceedings on the implementation of the Colombian Peace Agreement" and aims to discuss thepossible problems arising from the peace agreement between the FARC and the Colombian government, in the hypothesis that it contradicts international human rights treaties. Thus, after a brief and necessary presentation of the historical context, the structure and proceedings of the International Courts that have jurisdiction over its member state Colombia will be presented. Next, the analysis of specific situations and, from the legal provisions of the treaties and its jurisprudence, conclude whether the Peace Pact is in agreement or disagreement with International Law, represented by the Inter-American Human Rights System and the International Criminal Court and, in case of noncompliance, an attempt will be made to answer how these international human rights courts can intervene in order to uphold their precepts and defense of the victims of armed conflict.
