A dívida ativa da União: um estudo da recuperação dos créditos inscritos

Abstract

Nos últimos anos, a crise fiscal do Estado brasileiro tem sido um tema bastante recorrente. Desde a década de oitenta, o Brasil vem passando por uma série de ajustes de modo a equilibrar as suas finanças. Para isto aumentou a sua receita e diminuiu o seu gasto. O debate do problema fiscal brasileiro é sempre pelo lado das despesas, não se analisando se as receitas devidas ao Estado brasileiro estão sendo arrecadadas, como é o caso da Dívida Ativa da União, que vem crescendo constantemente. Este trabalho apresenta os resultados de uma pesquisa sobre a recuperação dos créditos inscritos na Dívida Ativa da União. Foram investigados os motivos pelos quais a recuperação destes créditos é tão baixa. Para tanto, foi realizado um estudo da Dívida Ativa da União e do processo de cobrança destes créditos, identificando os atores envolvidos neste processo e os fatores que influenciam a recuperação destes créditos. Foi analisado o modo de influência destes fatores no processo. Esta pesquisa tem uma parte qualitativa muito forte, pois as entrevistas com os atores do processo foram fundamentais para as conclusões. Os resultados da pesquisa demonstram que a cobrança dos créditos inscritos na Dívida Ativa da União é uma tarefa difícil, com um amplo espectro de fatores que dificultam e emperram o processo de recuperação dos créditos, fatores estes que se referem tanto a questões de ordem técnica, como a questões de ordem política.

The fiscal crisis of the Brazilian State, in the last years, has been a quite appealing theme. Since the eighty’s Brazil has been through a series of adjustments of their finance balance. To reach this purpose, the focus has been over the years to raise the income and reduce the expenses. The debate over this matter has always focused the expenses, putting aside the analysis of the due incomes to the Brazilian State and if this income has been properly collected, as it is the case of the Active Public Debt, which is constantly growing. This work shows the results of a research that has been carried on the recovery of the credits enrolled in the Active Public Debt. It was investigated the reasons why the recovery of these credits is so low. With this objective, a study of the Active Public Debt and the processes of collection of its credits were done, having in mind the identification of those involved on this process and the factors that might have influenced the recovery of these credits. This research has a very strong qualitative support, since interviews with the people involved on the process were fundamental to reach the conclusions. The result of the research shows that the collection of the credits enrolled in the Active Public Debt is a difficult task to be achieved. It has a wide spectrum of factors that contribute to make difficult the process of recovery of the credits. These factors are related both to subjects of technical and political order.
