A liberdade de imprensa no Brasil e o direito de resposta

Abstract

O presente trabalho busca analisar a efetivação da liberdade de imprensa no Brasil, com especial ênfase nos contornos do direito de resposta. Para tanto, o estudo parte das origens e desenvolvimento da imprensa, desde o advento da prensa de Gutemberg, passando pelas revoluções liberais que estabeleceram as bases jurídicas e políticas para consolidação da liberdade de imprensa, até a legitimação do campo jornalístico, mediante reconhecimento de sua necessidade para a formação da opinião pública. Prosseguindo no estudo dessa temática, o trabalho aborda os marcos normativos da liberdade de imprensa no Brasil, destacando os principais aspectos dessas leis e sua relação de cada uma delas com os contextos históricos e políticos das épocas em que foram editadas. Ainda quanto a esse item, o trabalho examina os contornos do direito de resposta em cada uma dessas leis, bem como eventuais embaraços legais à liberdade jornalística. A seguir, o estudo trata do reconhecimento pelo STF da incompatibilidade da Lei de Imprensa com a Constituição de 1988, abordando as razões para essa decisão e as considerações da Suprema Corte sobre a noção de liberdade de imprensa. Ademais, analisa aspectos da Lei 13.188/15, editada para suprir a lacuna legal na disciplina do direito de resposta após a invalidação da Lei de imprensa. Por fim, o trabalho propõe uma análise dos principais itens desse novo diploma legal e seus reflexos na liberdade de expressão do campo jornalístico e na defesa das vítimas de abusos dessa liberdade, buscando trazer um enfoque que contribua para o equilíbrio desses interesses conflitantes.

The present work seeks to analyze the effectiveness of the freedom of the press in Brazil, with special emphasis on the contours of the right of reply. To this end, the study is based on the origins and development of the press, from the advent of the Gutemberg press, through the liberal revolutions that established the juridical and political bases for consolidating freedom of the press, to legitimize the journalistic field, through recognition of its need for the formation of public opinion. The paper focuses on the normative frameworks of freedom of the press in Brazil, highlighting the main aspects of these laws and their relation between each one of them with the historical and political contexts of the times in which they were edited. Still on this item, the work examines the contours of the right of reply in each one of these laws, as well as possible legal embarrassments to journalistic freedom. Next, the study deals with the recognition by the STF of the incompatibility of the Press Law with the Constitution of 1988, addressing the reasons for this decision and the Supreme Court's considerations on the notion of freedom of the press. In addition, it analyzes aspects of Law 13188/15, edited to fill the legal gap in the discipline of the right of reply after the invalidation of the Press Law. Finally, the paper proposes an analysis of the main elements of this new legal document and its repercussions on the freedom of expression of the journalistic field and the defense of the victims of abuse of this freedom, seeking to bring an approach that contributes to the balance of these conflicting interests.
