Parentalidade socioafetiva e multiparentalidade: implicações sucessórias

Abstract

O presente estudo tem por objetivo analisar o reconhecimento tácito e jurídico dos novos vínculos parentais fomentados dentro da realidade da afetividade, e a possibilidade da coexistência com vínculos de origem biológica através da multiparentalidade. Repercutindo os efeitos dela decorrente, com especial atenção aos direitos sucessórios. Utilizou-se do método dedutivo, através da pesquisa bibliográfica. Inicialmente busca-se numa abordagem histórico-sociológica resgatar o surgimento da família e dos primeiros vínculos parentais, através da evolução dos conceitos de família, afeto e parentesco. O trabalho segue aprofundando os efeitos das alterações provocadas dentro da realidade das famílias, demostrando o protagonismo do afeto dentro delas e tenta traçar um conceito contemporâneo de família. A tutela jurídica da afetividade é discutida com base nos princípios constitucionais da igualdade, solidariedade, liberdade e na dignidade da pessoa humana. Abordou-se também quais os requisitos necessários para constituição do vínculo socioafetivo e a importância da posse do estado de filho nesse reconhecimento. A igualdade entre filiações também é colocada no debate, a sua importância e a tutela constitucional desse direito, e diante disso embaçasse a igualdade de direitos e deveres na multiparentalidade. Na multiparentalidade analisouse as recentes decisões dos tribunais estaduais e a votação do Recurso Extraordinário no STF, fazendo por fim um apanhado doutrinário dos efeitos sucessórios e patrimoniais das decisões.

The present study aims at analyzing the tacit and legal recognition of new parental relationships fostered within the reality of affectivity, and the possibility of coexistence with biological links through multiparentality, repercussing its effects, with special attention to inheritance rights. The deductive method was used through bibliographic research. Initially, a historical-sociological approach is sought in order to rescue the emergence of the family and the first parental relationships, through the evolution of the concepts of family, affection and kinship. The work continues deepening the effects of the changes provoked within the reality of the families, showing the protagonism of the affection within them and tries to draw a contemporary concept of family. The legal protection of affectivity is discussed based on the constitutional principles of equality, solidarity, freedom and dignity of the human being. It was also discussed the necessary requirements for the constitution of the socio-affective bond and the importance of the possession of the condition of son in this recognition. The equality between filiations is also placed in the debate, its importance and the constitutional protection of this right, and on that basis the equality of rights and duties in multiparentality. In the multiparentality the recent decisions of the state courts and Superior Court of Justice were analyzed, as well as the voting of the Extraordinary Appeal in the Supreme Court, finally making a doctrinal collection of the inheritance and patrimonial effects of the decisions.
