Globalização e periferia mundial: um discurso acerca da (in) efetividade dos direitos fundamentais

Abstract

O Presente trabalho surgiu da necessidade de entender a situação dos Direitos Humanos e Fundamentais perante o cenário pós-moderno no qual diversos fenômenos, como a globalização, o neoliberalismo e a própria crise do estado nacional perfazem-se como verdadeiros óbices contemporâneos à sua efetividade. A situação acentua-se na denominada periferia do capitalismo financeiro, na qual as promessas constitucionais de universalização desses Direitos nunca se cumpriram. A hipótese precípua, então, partiu da ideia de que para entender as razões da (in) efetividade social dos direitos Fundamentais, na realidade periférica, é imprescindível uma análise da história e formação local do país, suas idiossincrasias, enquanto periférico, bem como do entendimento de fenômenos contemporâneos de amplitude planetária. Nesse sentido, a pesquisa estabeleceu uma análise do problema da efetividade dos Direitos fundamentais através de sua inserção no contexto global contemporâneo, mas também numa perspectiva que levou em consideração particularidades históricas e sociais. Para tanto, utilizou-se do raciocínio hipotético-dedutivo, com predomínio de investigações histórico-jurídicas e da utilização de estratégias da pesquisa teórica (bibliográfica).

The presente work arose from a need to understand the situation of fundamental and Human Rights given the scenario post-modern in whitch a variety of phenomena, such as globalisation, neoliberalismo and the crisis of the national state make up as real obstacles contemporary to it’s effectiveness. The situation is accentuated in the so called petiphery of financial capitalismo, in whitch the promises of constitutional universallization of these Rights never were fulfilled. The hypothesis function, then, departed from the idea that to understand the reasons for the (in) effectiveness of social fundamental rights, in reality peripheral, It is essential to na analysis of the history and formation of the country, it’s idiosyncrasies, while the peripheral, as well as the understanding of the contemporary phenomenon of amplitude planetary. In this sense, the research established a problem analysis of the effectiveness of the fundamental Rights research established a problem of the effectiveness of the fundamental Rights through it’s insertion in the global context the contemporary, but also from a perspective that took into account the particularitities of historical and social.
