Title: Limitações às sanções administrativas Tributárias

Abstract: O objeto de estudo do Direito Tributário é a relação obrigacional existente entre o Estado (polo ativo) e os contribuintes (polo passivo), responsáveis pelo adimplemento da obrigação principal, referente ao pagamento dos tributos, e pelo cumprimento das obrigações acessórias ou instrumentais delas decorrente. Nesta relação, há hipóteses de condutas previstas em lei que, acontecendo no mundo fenomênico, geram uma ação (conseqüência), que é o surgimento da obrigação tributária, principal ou acessória. Pois bem, o não cumprimento das obrigações tributárias faz surgir uma nova relação jurídica, em que o sujeito ativo pode atuar de forma coativa para obrigar o sujeito passivo a cumprir a prestação, por meio da aplicação de sanções tributárias. Esta última relação diferencia-se da primeira, pois a hipótese é um ato ilícito (descumprimento da norma de conduta). O objetivo da pesquisa realizada no presente trabalho é concluir se existem limites para aplicação das sanções fiscais tributárias e, se for o caso, identificá-los. É fato que o poder de tributar sofre restrições ou limitações, conforme previsão expressa na Constituição Federal de 1988. Já a falta de uma definição clara dos limites ao poder de sancionar, pode desviar a função das sanções, que deve ser de ressarcimento, punição ou educação, gerando abusos de poder e restrições a direitos individuais. Diante do exposto, a partir da definição do que é uma sanção tributária e qual seus objetivos, mostra-se necessário que as sanções fiscais tenham limitações quantitativas (vedação ao confisco) e qualitativas (proporcionalidade e razoabilidade), além de formais (legalidade) e materiais (capacidade contributiva).
The Tax Law has as object the obligation-oriented relationships between the State (the tax body) and the taxpayers (taxable person), responsible for the main obligation, payment of the duties and for the compliance of the ancillary obligations or instrumentals. In such relationship there will be rules of conduct which forecast a hypothesis and an action (consequence), happening the hypothetical fact in the phenomenal world, originating the so called duty obligation, either main or ancillary, as consequence. Well then, in the case of not compliance of the duty obligations, upraises a new law relation in which the tax body can act in a coactive form in order to oblige the taxable person to pay the tax, via the application of sanctions. This last relationship differs from the first because the hypothesis is an illicit act (non compliance of the rule of conduct). The objective of the research herewith is to conclude if there are limits for the application of the tax penalties and, if it is the case, identify them. It is fact that the power to tax is under restrictions or limitations. On the other side, the lack of establishing limits to the power of sanctioning can deviate the purpose of the sanctions which are compensation, punishment or education, generating power abuse and restrictions to individual rights. Based on the above considerations, taking in consideration the definition of what is a duty sanction and what are its objectives, it is necessary that the tax penalties shall have quantitative limitations (confiscation block) and qualitative (proportionality and reasonability), other than formal (legality) and material (ability to pay).
