Tesouro do Lixo: Construção de uma sociedade Sustentável diante dos parâmetros estabelecidos na Lei 12.305/2010 Que institui a Política Nacional de Resíduos Sólidos

Abstract

O aumento da população mundial associado à intensificação do consumismo tem produzido acumulo de lixo, causando grande desperdício de materiais que poderiam ser usados em reciclagem, transformando o lixo em “Tesouro”, entretanto, suscita problemas socioambientais, acarretando difícil preservação dos recursos naturais do Planeta. Além do que, em grande parte dos municípios brasileiros, constata-se a inexistência de reflexão teórica sobre a PNRS. Nesse sentido, o presente trabalho analisa a atual aplicabilidade da Lei 12.305/10. Assim, a partir de uma noção histórico-propedêutica do caminho percorrido pelo lixo, torna-se fundamental elucidar a PNRS através de contexto crítico analítico da lei, com seus reflexos atuais na política pública e no plano geográfico, econômico e social, sem perder de vista a análise jurídica seus objetivos, princípios, metas e instrumentos que propiciam a abrangência de coeficientes de produção e consumo sustentáveis sem perder de vista a análise jurídica principiológica que inspira a proteção do meio ambiente.

The increase of the world population associated to the intensification of the consumerism has produced accumulation of trash, causing great waste of materials that could be used in recycling, transforming the garbage into "Treasure", however, it raises socioenvironmental problems, causing difficult preservation of the natural resources of the Planet . In addition, in most of the Brazilian municipalities, there is no theoretical reflection on the PNRS. In this sense, the present work analyzes the current applicability of Law 12.305 /10. Thus, from a historical-propaedeutic notion of the path traveled by garbage, it becomes fundamental to elucidate the PNRS through a critical analytical context of the law, with its current reflections in public policy and at the geographic, economic and social level, without losing of with a view to legal analysis of its objectives, principles, goals and instruments that allow for the inclusion of sustainable production and consumption coefficients without losing sight of the juridical legal analysis that inspires protection of the environment
