A possibilidade jurídica de alteração da filiação no registro civil de nascimento em benefício da verdade socioafetiva

Abstract

O presente trabalho tem por objeto discutir as possibilidades de alteração jurídica de alteração filiação no Registro Civil de nascimento, baseada nas relações de socioafetividade. Ao longo da pesquisa serão analisadas as modificações na estrutura da entidade familiar que deram origem à família contemporânea, a repercussão dos valores constitucionais no Direito de Família. Ademais, procura-se evidenciar a possibilidade de substituição da paternidade biológica em prol da paternidade socioafetiva, partindo da análise dos recursos disponíveis no ordenamento jurídico pátrio. Diante dessa problemática, fundado no método hipotético-dedutivo, parte dos argumentos gerais para os particulares, para demonstrar que toda filiação é socioafetiva e que algumas, além desta, representam também a verdade registral e biológica

The present work has the objective of discussing the possibilities of legal alteration of alteration in the Civil Registry of birth, based on socioaffectivity relations. Throughout the research will be analyzed the changes in the structure of the family entity that gave origin to the contemporary family, the repercussion of the constitutional values in Family Law. In addition, it is tried to evidence the possibility of substitution of the biological paternity in favor of the paternity socioafetiva, starting from the analysis of the resources available in the legal order of the country. In view of this problem, based on the hypothetical-deductive method, part of the general arguments for individuals, to demonstrate that all affiliation is socio-affective and that some, besides this, also represent the registration and biological truth.
